Off the books employment
If a company hires someone off the books and they are on disability ssi. And the person gets caught working is the company held responsible in any way?

A company in NY who hires an employee without paying taxes on that employee is in violation of several state and federal tax laws. While they may not owe any duty to SSI or worker's comp (that is the employee's fraud) they may have other liablity.
That said, the employee may be entitled to earn a certain income under SSI disablity. Many employees do not know this and they therefore commit a crime of perjury by lying to SSI about their true incomes. Encourage your employee to seek legal counsel from a Worker's comp/ Disability lawyer.

Attorneys are prohibited from facilitating illegal activities. But we should always adives against them; so I suggest you avoid this unnecessary risk.
