I would be very concerned about such a scheme. At the end of the day, it is appears that you are purposefully subverting labor laws you can pay a price. Further, this may not be a cost-saving move. You would then have to payroll these employees under that other entity, provide workers' comp and other employer compliance.

I was getting in line at Dollar General when my son walked up to a guy that works there and said "hello, how are you doing?" The guy then elbowed my son and told him to get away. My son has Autism and I've worked too hard with him so that he will socialize the way he does for some jerk to do this. The manager of the store was standing there and witnessed the whole thing but said nothing to her employee for elbowing my child. The guy never looked at me although I was yelling at him for hitting my son with his elbow, he bought a soda and chips and went to the back of the store to the breakroom. Write a letter to the District Manager of Dollar General. You can't expect the highest caliber of person to be employed there anyway, but you can still complain to management. Physical contact with a customer is most likely not allowable per their employment policy but I doubt you have any real cause of action unless you want to go with assault and battery. You would still have to get past the fact that there were no damages.

I see nothing wrong with defense counsel's request, but I don't think you have to go along with it. Your question is a bit vague, though. Did they make this request to you directly, or have they asked the court for an order?

When we paid January (in cash per his unusual request) He proceeded to tell us he was in foreclosure. He said not to worry that we had at least 2 months before we had to move out. We agreed he'd let February be FREE for us to use the money to find a different place.
We looked and found a place to buy. On January 14 we got him to sign and notarized that we had paid everything up to January in full and on-time. A week later he wanted for us to sign an agreement to vacate by January 31 which we did not sign since that was not the agreement we talked about. I didnt hear from him again and on January 30, he filed eviction. On February 10 final judgement came down on the house. we received eviction notice on Feb 12. I tried to contact him several times without success before the 12. He was avoiding me.

Your father is a criminal. You face the choice of having to accept the card as yours or putting your father in prison. You cannot resolve this "with filing papers."
To pursue this, swear out felony criminal charges in Mississippi. Push to have him arrested and tried and do not back down. Once you have done that, and you must act as soon as you found out, get the police report. Then contact the bank advising them that you are the victim of identity fraud, attach the police report and challenge the item on your credit reports. The bank will also want affidavits and they may also pursue your father.

What Attorney Ashman relates is probably correct, although I do not think that you have to pursue the criminal charges. You can, but you need not. However, you must make a report to the police in your area. Don't let them tell you they are too busy or give you an excuse. Find out who the identity theft officer is for the station and make them take a report so that you can either freeze your credit or put an extended security alert on your credit report. Once you have the police report, you will need to get your credit report and then contact the creditors/debt collectors who now have this debt. They will provide you with fraud affidavits. You will have to fill them out and get them notarized. It will then be up to them to pursue your father.
As an alternative, if you don't want your father to go to jail, you and he can have a conversation with the creditors. They may be willing to remove this from your credit report (no guarantees) and put this in your father's name provided that he is willing to accept responsibility for this account and start paying on it. However, if he was a crummy enough parent to do this to you to begin with, my guess is that he will not do the right thing now.

The only thing wrong with it at that time was it needed a new starter, which I fully disclosed on more than one time. I warned her to put oil and gas in it as soon as she drove away since it had been sitting for a while. 3 hours after the purchase, she's emailing me that "MY" (her) car's engine is blown. She is emailing me almost daily now (harassment, since I've asked her nicely to stop),demanding her $700 back, and threatening to take me to court for it. I have kept every email for this transaction since her first inquiry into the car. If it does go that far, to court, what is the probable outlook?

It is easy for us to say she is stuck buying a car without a warranty (which is what we would tell her if she posted), but she could sue in small claims - anyone can sue for anything. She could try to say you lied about the condition, or hid defects. That is why you always handle things in writing, and have a contract that clearly states it is sold "as is." You don't mention any written contracts. You might consider sending one last email, politely pointing out that she had full opportunity to inspect, that you offered no warranty, it was sold as is, and you consider that the end of the transaction. Be polite, but after that email, stop responding. You won't get anywhere going back and forth. It is a $700 car - hard to imagine it does not have a long list of issues.

As a general rule, if you can show she bought the car as is, you "win" but you'll spend money on a lawyer to defend you, and she could allege fraud.

"You bought the vehicle as is, without a warranty, and you had multiple opportunities to inspect the vehicle. What happens to it after the sale is thus your responsibility, so I regret I cannot assist you further. Please cease the continuing emails."

So I received a letter in the mail today just to find out that my grandmother had bought a whole life insurance policy on me years ago. The problem is that she passed away 4 years ago and her estate including my grandfather's (who passed away in 2010) are both in probate and the looks of it are that my uncle, who is trying to take everything in both estates, might just win the probate. My question is, since I am the primary insured is there any way for me to access the funds in the policy or will my uncle have complete control of it? On a side note the policy has been paid up until last year, keep in mind both of my grandparents are dead. Me and my father have come to the conclusion that my uncle was paying the policy after my grandparents had deceased, in attempt to get what money my grandparents had put in the policy.

you definitely need to consult a lawyer with all the documentation ASAP. You uncle could pay the premium (not after insured(s) died!) on your grandparents' insurance policy but could NOT change the beneficiary. If you are the valid beneficiary, the policy is not subject to probate. But it is impossible to tell exactly what is going on without seeing all the paperwork.

It sounds like you are the insured on the policy and not a beneficiary or owner. Your uncle will most likely inherit the policy through the probate and become the owner. As the owner he will have the ability to cash it in, borrow against it and changge the beneficiary.
However, as Ms Cusick says, you should have an attorney review the paperwork to verify who the owner of the policy is.

It appears thta you woudl meet the period of years criteria. But, Adverse may be at issue. If yrou family was given permission to use the easement, than it never was adverse. IF nt, then you coudl lose the easement, as it appears that you coudl possible get to the land fthrugh someone's property. For that reason, you might try to buy that portion of land. My twin infants who were born at 36 weeks, no abnormalities, obtained RSV while being cared for in St. Vincent Hospital (Carmel, IN). We were home for only 2 days before my daughter started displaying symptoms of RSV (turning blue during feedings, apnea). I took her to her pediatrician who said she had nasal congestion but lungs sounded clear and sent her home. The next day while breastfeeding, she had another episode which prompted another visit to the pediatrician. This time she was sent to Riverview Hospital to get a chest x-ray and blood work to look for infection. The test results showed some fluid around the pericardium, but she was sent home with no concerns. Next night, I was up with my daughter all night and eventually she stopped breathing and required CPR. She recovered and was rushed to Riverview ER where she was given a spinal tap and blood work looking for meningitis or sepsis. Her temp was 92.7 and O2 sats were in lower to upper 70's. She was placed on 2 L oxygen and then sent to St. Vincent's Children's Hospital (Indianapolis, IN). She was admitted with RSV. Next day, her brother was admitted to St. Vincent's Children Hospital with RSV and ended up in ICU where eventually he was intubated. While intubated, he required 2 blood transfusions to get better because nurses were drawing 2 mL of blood to waste before they drew a very small amount to test blood gasses (two times a day). This is in spite of knowing that his bone marrow was suppressed and not making new red blood cells. He was extubated only after 14 days only to be reintubated 3 days later for 9 more days. After extubation he was overdosed on Ativan....prescription was 0.2 mL and he was given 2.0 mL. Luckily i finally got to bring my baby boy home; however, he is now on an NG tube. I was told at the hospital that everything would resolve itselft within 6 weeks. We have been home for 10 weeks now and he is still on an NG tube. I have lost my job because i cannot go back until he is well as I am the primary care provider. At his GI appointment on April 19, 2012, I was told there is no need to do another swallow study because he cannot even swallow his own saliva without aspirating. There is speculation that damage has been done when he was intubated. My question is Do I have any legitimate claim for legal action?

He was arrested and charged with possession of firearm by convicted felon under first offender. This took place in Feb 2011, since then he has maxed out on probation and awaiting court. He haven't been into any more trouble the entire five years he's been on probation. Neighbors have getting statements about also seeing suspicious people in the neighborhood. Even the neighbor's whose car was in jeopardy gave a statement of some damages to his door. What's the chances that he could receive more probation from this and no jail time?

He wasn't charged with possession of a firearm by a convicted felon, he was charged with possession of a firearm by a 1st offender probationer. Whether or not he gets jail time is a function of many things: (1) the offense that put him on 1st offender probation; (2) the judge; (3) the evidence in the case; (4) the prosecutor; (5) the experience of his defense attorney. He needs a very good attorney and he should probably expect a probability of some jail time and loss of his first offender status. How bad it gets depends on what you didn't tell us (the original offense, the judge, the evidence, etc) and partly on how good his lawyer is and how fact he gets counsel. The fact there is crime in the neighborhood is not going to help when he knowingly gets a gun he isn't allowed to have because he simply cannot have one.

my drivers license was suspended due to a case of mistaken idenity. my sister hit a vehicle inside the apartment complex that i lived at and then she left the scene of the accident. someone that had seen her thought it was me. so when the cop arrived on the scene someone gave him my name and address. and at that time the officer had started issuing tickets in my name(keep in mind that the whole time all this was happening i knew absolutly nothing about anything that is happening at this point i didnt even know about the tickets the cop was writing.) and i guess a few minutes later the officer got a call that they had found the car and driver that had hit the vehicle inside the apartments, where i live. so the officer went to the place that my sister had gotten pulled over at. he wrote her out tickets for the vehicle she hit at the apartments and he wrote her out a few other tickets,my sister ended up in jail and anyway she got a lawyer and her case was settled. her insurance covered the vehile she hit. and then in march of this year i found out my D.L was suspended when i go to the courthouse to find out why they said it was b/c of an accident i had gotten into about a year ago and some unpaid tickets. turns out they were the tickets the cop wrote out when they thought i was at fault for the accident. i ended up having to go to court and the state dropped it. but know i have to pay to get my D.L reinstated i had to pay for a public defender, there where a couple days of work i missed because i couldnt drive. its been very stressful and i am a single mom with 3 kids i dont have the money to pay for all the stuff they (the court system). didnt fix like having my license reinstated late fees for a court date i didnt know about until a year later. You need to talk to a civil rights lawyer about this. My guess is that you don't have a case because the police and courts enjoy some sovereign immunity; furthermore, the first officer could have reasonably relied on the mistake, although that may be a question for a jury. That is why it is important you talk to a civil rights lawyer and not a criminal lawyer.

Today I was stunned to receive in the mail a letter from the local Sheriff's Department. It was a Writ of Execution (Money Judgment) for a case that I was never served with a subpoena. Evidently it is from a case back in 2008 in which I took out a yellow page ad and when the ad was published it contained incorrect information an did not include the promised caller tracking information. I had called the company to file a complaint but was told that the salesperson who sold me the ad was no longer employed there. I told them that I would not pay for and ad which was published incorrectly. They said they could not make any corrections since the ad had already published. So evidently there was a court judgment filed against me from 2010 in a county located 3 hours away from me. I would like to know my rights. Can I file for an injunction or perhaps a motion to quash service of process?

The problem I now have is that since the time the initial paper work was filed that lowered his child support, he has taken a postion with a new company. Under the circumstances, it is not a good idea for your family to put property in your name. Depending on the terms of the short sale, you may still have liability that can result in debt that would encumber the Florida property. You may eventually have to declare bankruptcy and may lose equity in the Floriday property as a result. It would make better sense for your family to hold title to the Florida property and to rent it to you for whatever sum seems appropriate.

To supplement the answer of the first responder, the greater risk is the 2nd mortgage. It is unlikely that you would ever be pursued for a deficiency on the first mortgage (for various legal and practical reasons which I will not get into here). The lender on the 2nd mortgage can sue you on the debt and can obtain a judgment if they are successful (or if you don't respond to the suit). Whether they obtain a judgment in NJ or in Florida, it can be enforced in Florida. You would really need to consult with a Florida attorney to discuss what kinds of collection efforts a judgment holder may proceed with in Florida, and what type of exposure you would have for real estate owned by you. Collection law varies from state to state. If the short sale results in the 2nd lender agreeing to FORGIVE the debt, then certainly that would be good for you. But be careful, an agreement to accept less in order to clear the lien and let the NJ property be sold is not the same as an agreement to forgive the debt. You did not say how much the 2nd mortgage is. Your analysis will depend on this, and how much exposure you have. Until the situation is analyzed, you do run a risk if you have other real estate "in your name." And also, as the other poster said, if you ever need to file bankrutpcy due to liability for the 2nd mortgage, your ability to do so without losing the FL property would be jeopardized.

The failure to protect private information can submit an attorney to discipline from the Supreme Court and civil liability to those affected. However, there may be times in which sharing sensitive information is part of the progress of a case. Sometimes banking information can be a legitimate subject of discovery. Even then, the most critical information (SS#, ACCT#, DOB) are to be redacted from documents, unless that information in legitimate Discovery information. Violating this trust, can be grounds for disbarment.
If your banking information was sent by an attorney in a case, directly to other represented parties, that can also be a breach of the duty to against improper communication. If they gave your banking information to the attorneys representing other parties, those other attorneys ar also bound to protect your private information. They may not be able to show it to their clients, even though they have a legitimate purpose for getting it from the first attorney. If it was your attorney that gave out the information, you need to ask them what was sent and why. Perhaps they had the belief that they had more authority to share information than you have actually given them. If you are not satisfied with the reasoning, then you can make a claim with the bar, and seek civil redress for your damages.
This has been a general description of possibilities based upon your very general description of the facts. Prior to deciding what to do, you should consult directly with legal counsel in your area. Get advice specific to the particular facts of your situation. There aren't a lot of attorneys that take on legal malpractice cases. I don't agree. Dividend payers and financial institutions don't always know the beneficial owner of securities. Seriously, no attorney can answer a question about why a personal representative would wait 7 years. A better question to ask would be why the beneficiaries ALLOWED this to occur. Surely at least one of them knew of the death? After 6 months, why did none of them contact a lawyer and see about probate if the named personal representative was not making a move to probate the will?
And why bother to probate an estate now? If there are no debts outstanding of the deceased or unless there are some other facts, I am not sure why this has to be probated now or what would be accomplished by probate unless its somehow required by law or other circumstances. However, I am not aware of any time limits for probate and this can be adjudicated now. I do have a problem with one sibling asking the others to deed over land without knowing the equity value of the land. If one person wants the land, that is fine, but he needs to buy out the shares of the others unless there is absolutely no value to them.
Regarding land, it is not necessary to probate the estate. If the deceased left land to more than one person, those benefiicaries who want the land should buy out the shares of those who do not. If the beneficiaries cannot agree on a value for the property, then any of the beneficiaries can bring what is called a partition action. In the partition action, the land will be divided if it is capable of being divided. In most cases it isn't and in that instance, the property will be sold off at a private or public sale to the highest bidder. The sale proceeds will then be divided among the heirs/beneficiaries of the property. Things like payments of the taxes, mortgage, insurance, maintenance and rental value of the property will all have to be factored in to arrive at the correct value of who owes what.
I have questions about what is really going on and what led to the post. My advice would be that if you received some sort of papers regarding probate of an estate in PA, that you find a probate lawyer who practices in the county where the estate is probated. Pay the attorney for a 30-60 minute consult and allow him/her to review the papers that you or the other heirs have received.

If you currently have an attorney, then call your attorney and he/she will know what to do so handle this situation. That is what you are paying your attorney for -- sit back & let your attorney do their job! The bad news is that your divorce has just gotten very expensive.
Unfortunately, this type of threat is not uncommon in a divorce. What your wife does not realize is that she is probably going to be liable for these credit card expenses in the end of the divorce -- she thinks that she is going to ruin your credit -- but in the long run if she signs your name then she is techinically committing a crime. For example, if she goes on a buying spree at Victoria Secret most judges know that men don't shop there! If she was smart she'd hit Home Depot and Best Buy but I doubt that she is thinking that smart!

I signed an employment contract for my current position within the company, which was signed on 7/29/2013. It states explicitly that I am due for a performance review in 4 months time. When I was not given a performance review on time, I inquired about it, was ignored for a week and a half, and then told that they were not going to do any employee performance reviews until January. This means that I am missing what will probably over 2 months of a pay increase that I agreed to receive 4 months from my start date. Is this a breach of my contract?

Without seeing the written document, it is impossible to say whether your employer is in breach.
If all it says is that you are entitled to a "performance review," then this may be "no harm, no foul." After all, a "performance review" is different from a "pay increase." It is quite permissible under the law to give a "performance review" and not increase the person's salary.

If you were 17 when you became pregnant there is no crime.
