Advice: get an attorney to represent you and plead your case the best he can on the new charges and the probation violation. You are not allowed to drive ANY vehicle without interlock, period. You don't get a 'freebie' because you chose a vehicle that didn't and couldn't have one. The judge and DA are going to take the position that was an intentional disregard of your probation terms.

Thursday Dropped her off at school and she was with me all night

Friday during the day all day until 4:30pm I drop her off at her dad's if it's his weekend and if not I would keep her Wed, Th, Fri, Sat, and part of Sunday until after her nap around 4:30pm and that's our switch off.

Then come Monday morning I always picked her up at 8:30 am and keep her until 4:30pm drop off and so on.

As you can see, my schedule has not been consistant since Dec.31 2011 to be able to sustain a job.

Now, he's been pushing her fulltime at school and pushing me to go to work....what do you suggest I do regarding this situation?

If we do file for divorce...what are the chances that the judge will be willing to give me more than 50% custody considering that she's barely turning 4 July 7th?

He's an attorney and it makes more sense for her to be with her mother for the most part I think because she wants to be with me. She shows anger towards me when she knows she needs to go to her daddy's even though she loves him, she's always been used to being with me 24/7 because that was our agreement if I stayed home. What do you suggest I do for each and every one of my concerns. I'd really appreciate your help so much.

You would need that to win the case. Plus, there are no damages that I can envision.

That would be a workers' compensation claim and assuming you can prove that the premature delivery was caused by stress of the job then you would be entitled to medical treatment cost over the normal delivery costs, temporary disability and any permanent disability resulting from the premature delivery. Permanent disability which usually is partial has to do with how the injury affects your ability to work. Having a baby prematurely may cause emotional/psychological injury. The baby may have the right to sue the supervisor and the employer for any injury caused by the premature birth. Again, you must prove that the premature delivery was caused by stress and expert testimony will be required from an obstetrician. That will be hard to obtain and expensive so unless the baby suffered permanent injury from the premature birth and the stress was excessive and not normal for the job and you did not take reasonable steps thhhho avoid it then it will be difficult to find a lawyer that will take the case and represent the baby. So you will need a workers

There are other problems with arbitration (primarily that it virtually always favors the lender), but that is the starting question. The best option to settle your debt - pay it. 1. "lein release": What you are looking for is a mechanic's lien waiver, with a properly completed contractor's affidavit. The roofing contractor needs to provide it. The lien waiver releases the lien rights; the affidavit discloses the subcontractors, including material supplier, involved in the job. The roofing contractor's waiver and affidavit SHOULD also attach a lien waiver from the material supplier, but the material supplier does not have to provide its own "contractor's affidavit". In small jobs the main contractor often does not want to provide material waivers, even though it is the law, especially if the material was purchased from some place like Loew's or Home Depot, and instead will use some "magic language" on the contractor's affidavit that, among other things, will identify the supplier. If it's done properly, it provides some level of protection against a material supplier tracing the goods to your job and then attempting to lien you.

2. "personal name": you should make out the check to the name of the company that you signed the contract with. Period. If they suggest making it out to both the company and the person, I would also avoid that one. And PS the lien waiver needs to come from the company you contracted with too -- NOT the individual.

Overall, since you don't know what you need and what it should look like, you should have an attorney who knows how to look at these kinds of documents review them for you. It's just too easy to make mistakes.

If the family violence case is dismissed - which would be a miracle given the type of charge - the probation could still be revoked on the facts of the dismissed case. It is absolutely impossible to answer the question you have posed.

Yes it is, besides pulling both axle, you have to remove the entire carrier assembly before you can remove the pinion shaft. I recommend you go to a good public library and take a look at the automotive books they have and check out the pictures and procedures to R/R the pinion bearings. Oh did I forget to mention you need a good long punch to drive out the old races in the housing and need to have the bearing on the pinion pulled off and a new one pressed on. Be sure to keep any shims on the side bearings in order as to not mix them up side to side or your clearances on the ring and pinion will get messed up. Mark the pinion nut with a center punch on the nut itself and the end of the pinion shaft so you can line them up during the assembly process. Line up and go past about a quarter inch or if you want you can check drag per instructions in the repair manual. I find marking it is easier and works fine if you didn't have a loose gear to gear clearance problem. Be sure to torque all bolts to specs and use blue lock tite to the threads. If you have doughts about doing the job, please seek help or take to a qualified shop. Making a mistake could be costly. Ring and pinion sets can be $200 to $400 and up. Good luck. John , Tacoma, Wa

Is the home in both names? If you filed and your wife did not, then the debt rolls over to her...

If the home is just in your name and you listed the hoa fees, you woudln't have to pay it if you weren't keeping the home. If you intend to stay in the home, then yes you would have to pay the hoa fees. The hoa fees are associated with the home... if you want to keep the home, you must pay the hoa fees. You can however get the late fees waived if in the bk and you pay during that time... unless your wife's name is on it, then it would all go to her.

You committed fraud and want to know if you can fix it? The answer is you can't.

Let me start by saying than in posting in the part of LawGuru that deals with house closings and sales rather than landlord tenant law, most attorneys that handle such cases won't see your question.

You have a problem that cannot be fixed. When you lose the eviction case, you will (1) see your credit ruined for 7 years, (2) have a judgment against you and may face garnishment of your bank account and pay, and levy on your property, and (3) unless you have a written agreement with your "friend" probably have no remedy against the friend.

You'll need to pay the landlord, let them take money from you by garnishment, or go bankrupt.

I'm sorry to hear about what has been happening to you. Some of your co-workers sound ignorant. First, I assume that you have not had any negative employment action as a result of this harassment, such as lost wages or no promotion.

The smart thing to do is to try to correct the issues by speaking with HR and management like you did. The EEOC explains some of this on its website:

I'd also read the company policy carefully and document your complaints with HR/employer, as well as any steps you took to remedy the situation. If the harassment doesn't stop after you complain and the employer acts, then you may have a case.

Check your insurance. You may have theft coverage. I agree that if your wife has BPD Grade III/IV, the last thing you want is to stress your wife out. But filing a theft claim also requires filing a police report.

If your wife is an outpatient, then I have to think she has calm intervals from time to time. That might be a good time to discuss the issues with her. She needs to believe that she still has some control over her life (unless she's an inpatient or an every day day patient, in which case she needs to accept her impairment and work on getting better).

In my personal opinion, and from what I've observed, it has the same effect as vertical lines, it makes the wearer look thinner but it does not make the wearer look tall or long. But all in all, it usually depends on the posture of the person's body.
Slouching on makes it worse, but having a straight and firm posture gives the right effect.

You don't respond to his response, at least not in family law proceedings. It is not clear what your hearing is, but it will most likely go forward if based on an earlier scheduling. You do need to make sure that you get a copy of his response, and if necessary, point out to the court that you did not receive his response.

Now to gain access to more capital with which to expand, I planned to set up an LLC that would seek capital from investors for a annualized rate of return on their investment. I had not planned to offer shares or ownership in the company just a rate of return to those investors that invest. However, if I understand correctly, under the SEC regulations I could not advertise or solicit the general public for investment

1) Am I correct in my understanding that I can not advertise or solicit the general public for investment?

2) How is it that developers etc are able to solicit to investors as I see on-line, on radio etc?

2)How can I legally notify the public of my offering in a legal manner?

Securities lawyers like to say there are three kinds of initial public offerings: registered, exempt and illegal.

You are more or less correct that you cannot advertise to or solicit from the general public. Limited advertising and solicitation is permissible in a small IPO under certain guidelines, but not generally.

If you are seeing advertising that seems to be improper, refer to my first paragraph above. Maybe it is illegal. Maybe it is exempt. Or, possibly, these guys have gone through a registration exercise and are permitted to advertise.

As to your third question, you are going to need to retain a lawyer with experience in the investments and securities area in order to raise money from the public except in the very simplest, quietest, most private way. Any advertising, any dealings with strangers, will require full and strict compliance with state and federal securities laws. There are lots of books, both hard- and soft-cover, dealing with financing your business by selling stock to others. Most of them speak to selling stock in corporations, but the same principles apply (generally, at least) to other securities including memberships or ownership interests in LLCs, limited partnership interests, and so forth. I would advise using such books to get a feel for the area, then interview and retain an attorney with "Blue Sky" experience, and perhaps a CPA as well.

I recently had xrays from independent Doctors that showed I have an injured spine. Soon after I had (possibly) my last AME. The AME was very rushed during the examination. After viewing the xrays the AME staff took, taking about a second to look at each one, he said he saw nothing. He also never let me explain all my ailments I was there to see him about by talking over me and rushing through the appointment because I was first after lunch with a waiting room full of other patients. I complained to my lawyer in an email before the AME report came out, of course not in my favor. I have asked my Lawyer about sueing him but he has not responded. My Lawyers staff has caused over a years delay in my case and he would like to get it over with, I want to fight. Please help.

AME is "God" in Workers' Comp claims.

You would need a video tape or multiple eye-witnesses to the AME's behavior to get his report set aside. IF IT IS YOUR WORD AGAINST THE AME's report, you will lose. I see nothing here over which to 'sue' the AME.

There is no requirement the AME go slowly during the exam. Xrays are considered a very poor measurement of an industrial injury; most need to be 'confirmed' with a CT or MRI or Nerve Conduction study. The only possible remedy is for the Attorney to schedule (paying nearly $1,000 out of pocket) the AME's deposition and confront the AME with documentation of a condition or injury which the AME failed to observe in the most recently report. The AME will very strongly resist changing his opinion.

So without hard evidence that the AME missed something substantial, there is little value in the deposition. Finding another attorney now would result in the 2d Attorney doing 100 hours of work to split te 15% fee; if the fee looks like it will be $2000 and he would get $1000, the new attorney would work for $10/hour... making you a very unattractive client!!!

One solution might be to insist your attorney confront the AME at a deposition by a certain date or you will either terminate that attorney and represent yourself or complain to the bar association about being 'abandoned', 'inspiring ' your attorney to confront the AME at a Deposition.

Just don't expect the AME to change many answers unless there are studies showing injuries and disability he actually completely missed.

Most MLS listing contracts are fully vetted by the local MLS and binding, yet subject to rescission or termination for breach. If you want to know if your "MLA Contract" is a standard MLS listing contract, ask a title company or another realtor for a copy of a standard MLS listing contract for your area and compare the two. You also can find several versions online. These are relatively standardized nationwide because Century 21, Remax, Coldwell Banker, Prudential, etc are nationwide. That said, it is common for real estate agents to screw up the MLS listing contract, the listing, or the sales contract, and a good real estate attorney can let you know if that is your situation -- but it will not happen for free unless you have a lawyer friend or lawyer relative who is feeling generous.

It is generally fully acceptable for you to enter an agreement whereby you will specifically state the amount owed and you will move out and pay that off. As a practical matter most landlords are reasonable, and want to get paid.

If your father left a wil, the will needs to be probated, and if he didn't, the default provisions set out in the Texas Probate code apply as to how things are going to work. I could be wrong here, but something about your post makes me think that perhaps your family is from another country with very different laws. If so, please realize those laws don't apply to property and persons here--while you're in Texas, Texas law applies. You can see an attorney for defamation. The first thing to do is to tell the company in writing that their employee is defaming your husband in this way and you are going to get a lawyer if she doesn't stop. There is an outside chance of finding her employer liable if she's doing it in the course and scope of her employment. It's not the strongest case for several reasons however.

In some instances they have to dismiss the case if you do not testify. In other situations they can go forward with a trial even if you don't testify.

The decision of whether or not to have a restraining order is up to the judge. Sadly, judges do not always listen to the victim in deciding whether or not to sign a restraining order but you can go to his next court appearance and ask to speak to the judge, telling him or her, that you do not want a restraining order and that you are not afraid of your boyfriend. Some judges will require that you speak to a victim's advocate before you speak to the judge. So you will be best off if you call the DA's office and ask to speak to a victim's advocate first.

First and foremost, make sure that there is no way the Judge who took your plea can be said to have jurisdiction. Judges in the Commonwealth of Pennsylvania have jurisdiction in the County in which they were elected, this is true. However, county law enforcement often share and transfer jurisdicton of criminal acts. So even if your crime initialy occurred in another county if the crime continued through to the county in which you pled or if the county where the crime initially occurred transferred jurisdiction to the county in which you pled you may not have a challenge to jurisdiction.

If, however, you are certain the Judge, who took your plea had no jurisdiction to do so, you may file a Petition under the Post Conviction Relief Act. This Act is designed to provide folks convicted of crimes a last ditch effort to challenge the conviction. As for the deadlines to file, generally you have ten days after you plead guilty and are sentenced, to file a Petition or Motion asking the Judge to reconsider the sentence you were given or to allow you to withdraw your guilty plea. You also have thirty days from the day you are sentenced to file an appeal of the sentence to a higher court.

But, if ou believe you have missed the deadlines to file any appeals you may seek to file Nunc Pro Tunct, which means you are asking the Court,( in which you pled guilty), to permit you to file for relief despite having missed filing deadlines, you are in essence seeking to reinstate your appellate rights. The Nunc Pro Tunct filing requires that you provide a legally sound reason for having missed the statutory filing deadlines.

I would you suggest you go to the Courthouse where you plead and ask to see the Record of conviction and or sentencing order, this will provide you with the date when you plead and give you an idea of what your appeals date timeline would have been.

Also find out if at the time of your plea the proceedings were being recorded either by a Court Reporter/Stenographer or by Digital recording. The notes or transcripts from the plea proceedings would be helpful to allow you to determine whether or not the attorney or the Judge advised you of your appeals right. After every person is sentenced in Pennsyvania the attorney or sometimes the Judge orally tells the person his or her appellate rights. Also make sure you did not sign any documents entitled ,"Appellate rights or rights on appeal".

Your question is a little unclear, but if the question is whether CPS may request that the court order a paternity test once your child is born, the answer is yes. If there is a question of contact between you and the father after you were not to have contact as a condition of reunification with your older chidren, then you are at risk of having CPS take your newborn. I recommend that you begin a counseling and recovery program as soon as possible so that if it is confirmed that the children have the same father, you will be able to represent to the court that you are taking steps to end the relationship and keep all of the children out of harms way. They have harrased us and complain that we make too much noise during regular hours, they've even called the police on us, i recevied a notice to cease on 11/21//2013. I've explained that I have young children and they are active like normal children during the day. I now am working and have my children in camp and in daycare. I recently had an issue with my door on 8/3/2014, where our door had gotten stuck and we could not get out, i called maintenece but they are not available on saturdays or sundays so my boyfriend, had to bang on the door with a hammer to help me and the children get out, this was around 5pm. I received a letter via ups from a lawyer stating they represented the property owners on August 8th 2014, and that they were evicting us because of noise complaints, the last complaint being 8/3/2014 (the door incident) and we need to leave the premises by september 30th, 2014 they also attached the 11/21/2013 cease notice. These complaint are being made falsely because the cease notice says no noise during the hours of 10pm-9am, my children are in bed by that time. the tenants underneath always bang on our floor when ever my son walks during the day.

I would like to know if they can evict me so quickly with young children for false accusation , my oldest son will be starting school soon and is currently in camp and they are putting me in a tight spot. what can i do?

She then entered the home and took things out and home with her without anyone's knowledge until after the fact (there are 5 of us). I received paperwork to sign to make her executor, but my other 2 siblings prefer that either I or my husband take that role. However, I can see hurdles with her and my other sibling. What happens if I don't agree to her being executor? And can she really just take things out of the home without the estate being divided yet??

Not really sure what you mean by your sister wanting to be co-executor. The will should have named someone as executor and that person should apply to the court to be executor unless they don't want to be. Your sister should not have changed locks or removed property. You should consult with estate administration attorney to help you with the process.

You make a lot of inconsistent statements. First, you state your father's will is in probate. If that is the case, then your father had a written will which was submitted to the court. The person named in the will is the personal representative - you do not get to pick, unless it is agreed by all the heirs that the named personal representative will renounce or if there is some other problem in which the named personal representative fails to qualify for whatever reason. If that is the case, the back up personal representative named in the will takes over, if any.

You also state that your sister is a co-executor and has not been named yet. How do you know then? Why has'n she been named if the will is in probate? Has she and the other-co-executor applied for letters testamentary? Usually, this would be done when the will is submitted for probate or shortly thereafter. And who is the other co-executor?

Why would you get a paper you have to sign to make her the personal representative if there is a will naming her? You state there is a co-executor, but why would this paper just name her?

There should be one captain of the ship so I am not in favor of co-executors. If there is no will or if the will does not name a personal representative, then any of the siblings can apply. If the matter is not agreed upon, then the clerk will hear the objections and appoint someone. If there is a chance of that, then I would immediately contact a probate attorney in the county/state where your father resided at the time of his death to hire that the lawyer to object to the appointment of your sister and seek out the appointment as personal representative. Before you do, contact the county and get a copy of the will and any other documents on file (application for letters, etc.) and bring this information to the probate attorney. Anyone can access the probate file as it is a matter of public record.

You state that your sister changed the locks and removed items from the home. If there is a will and it names your sister as the personal representative, then she would have a duty to secure the property of your father for safekeeping until it could be inventoried. While I do not take issue with her doing that, she ought not to have removed items from the home. Those things must be accounted for. However, she should not have done this until she has been appointed. This is all the reason why it is imperative that you contact a probate attorney quickly.
