My brother passed away leaving all his estate to me...all my brothers, sister, and mother waived all rights to the estate in a signed, notarized affidavit...can the will be contested after this is signed?
Answer
As potential heirs, they retain the right to contest the will for 2 years from the date of the order to admit the will into probate. The affidavit doesn't relinquish their rights; if any evidence comes up that might invalidate the will, they would be able to use it.
