I have a tenant who was under a one year lease, who is now leaving with 30 days verbal termination 6 months early. He has destroyed several different areas of the property and is fighting to get his security deposit back. What are my rights as the landlord for the tenant breaking his contract? I have looked over the VA code and can only find tenant rights.



Answer

Assuming no material breach on your part as the landlord nor any basis for a setoff claim, this lease breaking tenant should be incrementally liable for each and every month's remaining rent as it accrues up to the lease termination date as well as any damages to the property which exceed normal "wear and tear".
