Question

Employee/Employer Conflict

I have worked for a company for many years and was about to start my own company. They bid on a job and I also bid on the same job while being employed with them. I was asked to resign and threatned with legal action. Is there a law against this and what catorgory does this fall under so I can further investigate this? Thank you.

Answer

Re: Employee/Employer Conflict

Bidding on a job in direct competition with an employer by while employed by them could be called tortious interference with business relations and/or unlawful use of business trade secrets. You could be found liable for substantial damages, particularly if you are found to be under a covenant not to compete with them.
