I live in the state of California he walked with his process server into my church tonight the process server asked my husband his first name and he said here buddy youve been served. My former landlord was standing next to him and handed my papers to me himself. Is this legal? Can he come into my place of worship and hand me lawsuit papers? Have I been served?

He is free to do it anywhere he can find you without committing a crime to reach you. Technically, if the landlord handed you the papers, the service on you was not valid, because an interested party cannot serve process. All you are going to do by contesting it, though is waste time. Since all he has to do is have a process server reserve you.

The only way for this question to make sense is if you put gasoline in a diesel car, sinse gas engines in cars have been running on unleaded for a couple of decades.But basically if the engine ran fine when you took it to the shop no damage is done. Get the tank drained, maybe replace fuel filters and you're OK.

He said that he didn't have his id with him and I trusted him to be 21 (bad idea!). I was told by the police that I am going to be charged with a gross misdemeanor. I am currently working at a hospital as a rehabilitation therapist. I have been an employee of the company for 4.5 years. In the past two years I have had a few altercations with a subordinate rehab technician. I can describe the altercations in more detail but it would take up 10 pages. Basically, this person behaves as if my opinion (as well as several others') does not matter and he can do his job however he wants. With the exception of maybe my immediate supervisor, he ignores orders, talks back and, to me, has been verbally aggressive and abusive. His job only exists because of my license to practice. There are three therapists and two rehab technicians in our department. It is my and one other colleague's license that he works off of. Our confrontations have always involved some type of either insubordinate behavior where he ignored something he was asked to do or he was doing something harmful to a patient or chose to make changes to the department without consulting anyone else. Initially it started in Jan2012. I complained and wrote a 3 page report of his behavior to our boss. Each time I complained to her, his aggression towards me increased dramatically. After about 2 months it subsided and we began having a more cordial relationship. I purposefully avoided antagonizing Him even if it meant not getting something i needed that was within his job description to do. Then last month I had a random encounter with him in a patient's room. He was again doing something he was not supposed to do and I became upset as it was an order I had given him that he was ignoring. I attempted to distance myself from him immediately because of his aggressive nature. However he complained to our boss. Our boss then addressed the situation during a staff meeting. This incited rage and aggressive screaming from the technician at me during which he spoke about how he thinks everything I do is meant in someway to antagonize him and also discussed my bowel habits when using our shared staff bathroom. My boss forced me to participate in the arguement after I said at least three times that I did not want to say anything while he was screaming at me. I can provide more details of what was said but again it would be a ten page account. After this meeting, I called my HR rep and complained about his behavior towards me, told her that I felt threatened by him and that though I am willing to go to my boss, I am afraid as with the last time he becomes increasingly more hostile towards me each time i go to her. Later my boss and her supervisor wrote both him and me up. They wrote me up and cited my "tone" of voice when speaking to him was condescending, and also for a one time uniform violation and because I come in late a lot. I have done SOOO much for this department including things that were intended to increase team morale, but I received very little acknwedgement for it. I am willing to accept fault for my "tone" but its perception as condescending is subjective at best and when asked, my supervisors had trouble presenting exact examples of this tone. After this I was very upset. I feel they are trying to lay culpability on me to excuse the fact that they have not truly done anything concrete to control his behavior. This is at will employment. several years ago I was bullied by another coworker at different job. I was let go from that job because again i stood up against being bullied and refused to work with this person. There They used the fact that I called off too many times as a way to write me up and fire me. I hadn't done anything wrong up until that point so they had to find something, right? I am willing to admit my interpersonal skills are not perfect, but there are several very big positive things that I have done for my current job. And I KNOW that no matter how condescending my tone, I have never done ANYTHING worthy of being verbally abused and subjected to that level of hostility from someone who only has a job because of my license. I will probably leave this job soon because I don't want to get fired again but my frustration over being written up has caused me great disdain and even severe angina and heart issues. Doubtful. Schools have a lot of authority to set rules regarding dress code at school. Banning hats, bandanas, etc. are extremely common dress code rules for schools. Perhaps you could find a different way to raise awareness regarding the district's conduct, such as forming a student organization or convincing your school paper to run a story.

I agree with Attorney Canipe. The child is the man's sole heir provided that the child is legitimate and paternity has been acknowledged. You do not indicate if the child was born in out of wedlock. If no paternity is established, the child must seek to establish that but since he is a minor his mother or guardian must do that.

And just because the child is the mother does not make her an automatic guardian. If the man left assets over $1500 and that would go to the child, then a guardian will have to be appointed to manage the child's money and the guardian will have to be bonded. Otherwise the child's share of the money would be paid into court and given to the child at age 18.

If paternity is not established and the child is not otherwise acknowledged, then the man will be considered to have died without any children and his estate would then pass to his parents if he was unmarried. If both parents are deceased, then the sister and any other siblings or nieces and nephews if siblings are dead would inherit.

I was told I'd have to cancel the current escrow which would enable them to produce a new real estate purchase contract (including the reduced selling price) which was to allow us to move forward to closing. I signed the "Cancellation of Contract, Release of Deposit and Joint Escrow Instructions" only a couple of days ago (on July 28th) and it is highly unlikely that escrow has even seen it, much less had the time to process it.

I am now seriously anticipating my contacting the escrow officer and requesting that they put a "hold" or "freeze" on the current escrow cancellation pending the new, fully executed purchase contract signed by both buyer and seller (which has, yet, to be produced). In my opinion, the demand for my signing cancellation instructions was illegal coercion by the very fact that the realtor has failed to make any contact with me to initiate the new and agreed upon real estate purchase contract. This, most definitely, must be a violation of professional ethics.

I am refraining, at this time, from taking this matter up with the California Association of Realtors,

the California Dept. of Real Estate or the Calif. Real Estate License Board - all of whom I understand encourage and handle consumer complaints.

Judge Kennedy was reassigned to Chancery. judges get reassigned on a somewhat regular basis, as other judges retire, die or get reassigned. It may mean a delay in your case, but it is not bad per se.

You should contact the state attorney's office and explain that you do not want to press charges. The state is not obligated to follow your wishes, but many times they do. If the charges are dropped he will be in a much better situation than having a domestic battery on his record. Even if the state presses charges he is probably better of pleading not guilty since many times a lawyer can negotiate for a lesser charge like disorderly conduct. If he please to the charges he will probably receive a fine of about $600, a year of probation, and mandatory batterer's classes. A domestic battery conviction can also impact the ability to own a firearm and after 1 conviction the state can file subsequent battery charges as felonies.

However, until I or another attorney see the police reports I could not comment specifically about the circumstances. They will assert that they are reporting the truth; that is why we have trials. Your brother should consult an attorney directly about his circumstances, and certainly should not plead guilty without doing so.

You will want to discuss all of this with you attorney and your employer so that if issues arise, there are no surprises.

Selling now may or may not be a good idea. Is your mother on Medicaid? There are limits in each state as to how much income per month a person can receive and still be eligible for Medicaid. If the home is sold now and it is owned free and clear, at least half the money would belong to your mother and if she is still alive, this would probably be enough to get her to lose the Medicaid. She would then have to pay for the nursing home out of pocket until she could qualify again.

Also, how exactly is the property titled? Look at the deed. Is it owned by just you and your mother or by you and your mother as "joint tenants with right of survivorship"? Those words are important. If the deed does not contain language about survivorship, then it means that you only own 1/2 the land and that the other half would pass through an estate for your mother. And if she owes money to Medicaid, Medicaid is by law mandated to seek recovery, which means that you would might have to sell the property.

If your mother is still alive and in relative good mental health, I would take her to an elder care attorney and pay him/her to review the deed and your mother's whole asset/income picture. I would not attempt to sell the home now until you discuss this with an elder law attorney to see how to best maximize your mother's Medicaid benefits/eligibility (if she is on it now) as well as the tax issue. There are also tax consequences if you sell now, i.e., there may be capital gains tax. I don't know if its an issue for you as much as it may be for your mother. She will not be rolling over the proceeds into another home and she may have acquired the home a long time ago when it was worth far less. In such case, she might have huge capital gains even if she gave half the house to you. I am not a tax attorney - but this is something which should be addressed too.

You cannot take the default of someone who has filed an answer or other responsive pleading. If the answer is defective, you must either demur to the answer or file a motion to strike. It sounds to me like the answer is a complete admission, in which case you may be able to move for entry of a judgment of possession. I would have the documents examined carefully by legal counsel before proceeding.

Mr. Roach is correct. If a responsive pleading, no matter how defective, is filed by the defendant then there is no default. A demurrer or motion to strike would be a waste of time, however, as it would only result in them getting leave to file an amended answer. Courts don't decide cases based on someone screwing up the paperwork until they are given several chances to fix it and fail to correct the problem. You could file a motion for judgment on the pleadings, but in most courts it takes longer to get a motion hearing than to get a trial date in UD cases and if the tenant has even the slightest clue he would file an amended answer as soon as the motion was served. So personally, if it were one of my tenants, I would just treat it as if they had checked 2.a. and get the soonest possible trial date.

Although you don't say whether any boxes ended up being checked, e.g. 2.a or something in 3, and if not the Answer is technically defective, it is still sufficient to constitute a responsive pleading, and requires you to take another step (other than taking the tenant's default) to prosecute your case.......and I agree that the simplest approach would be to go to trial and let the judge hear both sides and decide the matter.

(1) The requested change is in the best interests of the children; AND

(2) ONE of the following:

(b) A child 12-years or older has requested a change in conservatorship;

(c) The other parent has voluntarily relinquished actual possession and care of the children for more than 6 months (not including military deployment).

If you threaten to modify child support based on his increased earnings, that might make him more pliant.

But one thing: never, ever, ever, deal with a family law issue without an attorney. Too much is at stake and the law is too complicated.

I called the payday loan lender and asked for their physical address so I could pay them via money order. They refused to give me the address and said the only methods of payment they accept is checking account info and credit or debit cards. What now? I don't want to give them my banking or credit card information.

Never ever do this again.

First payday lenders, if legit, must be registered in PA. Contact the PA Department of Banking to see if they are.

My best guess is that this is an overseas lender which does not have a valid US address. In such case, you do have a moral duty to repay.

You can either save the money and see if a legitimate collector comes to get it in which case you can resolve.

Or you can simply not pay. They will call you and harass you. They do not abide by the debt collection laws so the usual tactics of writing them will not work. They will also call and threaten you. Do not believe what they tell you (they lie!).

If you don't have the nerves to handle the onslaught then get a pre-paid debit card like at Wal-Mart. Put enough money on there to cover the payment to the payday lender and give them the information. Keep doing this until the loan and the exorbitant fees are repaid. That way, they cannot go on a raiding expedition of your bank account. Never ever let a company come in and access your bank account when they feel like it. Using a billpayer service is great so long as you get to decide who, when and how much gets paid. No autodrafts though as that is asking for trouble.

If, however, your question pertains to a situation in which the WRONG person was arrested, and you are truly the guilty one, this can easily be fixed. In 2009 I was arrested for domestic battery and charged under S784.30(1)(A). It was my first and only offense. Adjudication was with held and to my understanding, I was NOT convicted.

In 2010 I attempted to have my records sealed but my application was denied by FDLE.

I've had two attorney's tell me that it is possible to appeal the decision and win, however most of the information I gathered online states other wise. A plausable option I've read AND been told was that I could hire an attorney to withdraw my initial plea.

Could anyone please tell me how likely it is for me to do this? When I plead no contest I had no knowledge of the court system and what that meant. The public defender told me it would prevent me from receiving time, and it would not affect me in life, so I made decision based on that. They were wrong. I had ineffective assistance of legal counsel and I was misinformed.

Today I was offered employment contingent upon satisfactory background check, upon these findings the employment offer was with drawn. Now I am concerned that I will be denied entrance into nursing school due to this.

Is withdrawing my initial plea possible? Would it take long? Is it an expensive process?

The two attorneys gave you bad advice. You can not get a domestic battery charge sealed ever, even if adjudication was withheld. The statute makes it very clear that certain charges, among them murder, arson, and yes, domestic battery are never eligible to be sealed, even when adjudication was withheld. Withdrawing your plea MIGHT be an option. However, it is usually only done within 30 days of the plea. There are exceptions and your case may be one of them. You need to get an attorney as soon as possible. Hire one in the area that knows the judges and prosecutors and they will let you know what your chances are.

I advise you to exceed the statutory minimum and give your tenants a week's notice if possible, only to allow them to make the place as presentable as possible, and frankly, to keep them happy and cooperative. The last thing you want is for the tenants to trash the place or make it look totally undesirable, such that you either have to stop showing it all together or lower your asking price of prospective tenants.

Whether you are legally liable will depend to some extent on whether the agent was an employee or an independent contractor. In general, an employer is not able to sue an employee; the cost of having to defend yourself is also normally not considered a damage for which you can sue. If you merely rent office space, provide some clerical support, help with advice, the agent might be considered an independent contractor, who you could sue, but at this point you have no damages. If you are found to be at fault for his actions, the he is not an independent contractor; if he is an independent operator you probably can not be found at fault. sort of a Catch-22.

I write only to point out that whether a person is an employee or an "independent contractor" doesn't matter even without the statutory and regulatory provisions, on the issue of your liability to a third party. A principal is liable for the acts of their agent within the scope of the agency. You do not have to hire someone as an employee for them to be your agent. The only relevance of employee versus contractor is you cannot generally counter-sue an employee, and in fact must indemnify them.

In many instances an email can and will be considered a "writing" and can certainly be used to show assent to a contract modification (see federal eSign Act). But if the contract requires a physical signature from both parties this may not suffice.

What kind of crime? Where was the crime? Misdemeanor? Felony? Reason for not receiving notification? This is the reason I said you can't just ask a question on here without forming an attorney client relationship and thus the reason I suggested you contact an attorney in person. However, as I said originally, "generally" speaking, you can not be convicted of a crime without notice. Whether you are incarcerated or not makes no difference when it comes to notice.

And, if you were injured, instead of filing a case, you should see a lawyer. In other words, unless insurance pays and there are no injuries, you need counsel.

I don't understand your question. You cannot just pick a state statute of limitations because you feel like it. The statute of limitations is going to be either (a) the statute of limitations where you reside; or (b) the statute of limitations of the state in which you opened the account, whichever is longer.

Assuming the debt was created in PA and you reside in PA, the PA statute of limitations is 4 years. The 4 years begins to run from the date of your last payment of any kind on the account.

Why are you trying to use South Dakota and Delaware law unless you lived in either of those places when the debt was created? Just because the credit card companies are located there does not mean that you can use those statutes. South Dakota is especially puzzling as the sattute of limitations appears to be 6 years - which means that the creditor/collector has 6 years in which to sue. So its longer. Longer is bad.

Statutes of limitation are defenses that are used in court. You only have this available if you are sued. The defenses, if you have them, are raised in an answer and new matter.

An answer and new matter is a legal document and should be drafted by an attorney. If you are not sued, then the statute is irrelevant. As one creditor told me, "we don't have to abide by the statute of limitations and we can still collect the debt." I told them that's right and my client has an equal right not to pay!

Creditors, debt collectors and junk debt buyers are free to collect debts that are barred by the statute of limitations until you die. If you get a collection letter trying to collect on a debt that is barred, then you write to the collector and dispute the debt on the ground that it is barred by the statute of limitations and ask the collector not to bother you anymore about the debt. There is not a damn thing the collector can do in such case.

However, even though a debt is barred by the statute of limitations, it may still be reported on your credit report. Debts can generally stay on your report 7 years from the time that the debt is charged off or first sent for collection. Generally, that is about 7 1/2 years after you made your last payment.

The lease does not address the issue of what happens if the property is sold. It just says that the current lease between me and them is good for 99 years. But, I want to sell my property.

They own the 2 buildings on the property because it was their money that built them, but do I still have the right to sell my property and then tell the lessee that they will have to negotiate a new lease with the new owner?

Without looking at the leases, why would an entity build buildings on land that it does not own? Usually anything built on the landlord's property which becomes attached to the land becomes the LANDLORD's property. And why would you make a lease for 99 years????

Its your land. You can do what you want with it including selling it.

However, you are going to have a very difficult time selling land on which the organization has its buildings. I would suggest that you subdivide the land and enter into a purchase agreement with the organization for the purchase of the land on which their building sits. You can then sell your 2 acres to anyone else.

If you sell the entire parcel (assuming that you find a buyer) they will take subject to the existing lease. They could evict the tenant at the end of the 99 years if they wanted to. As I said, unless some is looking for commercial property to rent you may have a tough time selling this parcel to any other buyer.

If you believe that your wife is sincere about her settlement offer, then you should move quickly to hire an experienced family law attorney to draft a formal agreement for you both to sign.

If you have no prior record, you may be offered a pre-trial diversion program. It is, frankly, more annoying than punitive, but the benefit is that at the end of the program, which lasts typically six months, the charges are dropped. The program consists, essentially, of you having to perform some community service hours, maybe take a class on alcohol, pay some fines and costs, and that is about it.

The computers allow us to turn lanes on and off as well as make sales on items. We have had nothing but problems. The new system seems to be causing lots of problems with the scoring terminals and we have spent another 8000.00 in replacing items. We seem to be on the phone with tech support 2 times a week. Our customers are not happy. At this rate we will be out of business. Is there anything we can do?

It's hard to say what your remedies could be without taking a look at the contract you had/have with the company who provided and installed the systems.

I was at-fault in a single-car accident turned multiple car after.

My vehicle overturned on the interstate and I received a Louisiana 32:58 careless operation citation.

Is this worth hiring a lawyer for? Or do you recommend just pleading guilty and paying the fine?

I do find it unfair that I am considered "in attentive" after a car slowed down in front of me on the interstate and I tried to brake then lost control, while the other 3 subsequent vehicles were completely attentive after one hit my overturned vehicle (approx 5 mins after the accident), another hit that vehicle, and another swerved out the way and hit the parked vehicle of a Good Samaritan.

Never plead guilty to a ticket giver because of a collision. That plea can be treated like an admission of fault if you get sued. Contact your insurance company. Defending this ticket might be part of your insurer's "Duty to Defend".

At worst, plead no contest. Therefore you would have admitted nothing.

Recently, I've been toying with the idea of assigning individuals personal stocks as a potential adjustment to our current economic system, and I was wondering if I could get your take on the idea, which was originally developed by the Kollin brothers.

The basic premise is thus: Each individual is assigned a set of personal stocks. The government gets 5%, parents receive 20%, and the individual has the rest, and would be required to own at least 35% of themselves at any given time. The ability to buy and sell shares from other people-corporations would result in individuals literally investing in each other, which would ideally facilitate an environment in which people care for each other more effectively than altruism. Stocks could be sold off to gain capital in order to purchase education or equipment for a business, etc... which is very similar to a loan but for the fact that normal people can be involved, as opposed to only large financial entities. The individual would start off owning 75% of their shares, and any sales would be voluntary.

If you have a manual, the crankshaft journal standard size will be in "Technical Data" or a similar heading. If you remove the existing bearing shells, you will probably find a part number stamped on the back. This number may have a code affix like +005, or +010 if the crank has been ground and needs undersize shells.

Once 18, the "child" is an adult and, unless under a court guardianship or conservatorship, free to live independently. He/she is still governed by laws relating to school attendance (if any), but he/she is now an adult and can fend for him/herself. No money from Mom & Dad, though.

I had a realtor steal my identity. I made an offer to Edina reality to purchase a home. I had to send them an earnest check. The house was already sold to someone else but he did not tell me this until after I sent him the check. I did not get the house but he got all my personal information and my checking account numbers.

He was arrested about a year later. He had an id with his picture but all my information on it. I checked my bank statements I was able to stop payment on everything he did. So as far as I know he did not get away with any of my money. I am worried about what he might have all done using my identity, and how much of it is going to haunt me in the future.

Can I sue him and Edina reality, and for how much?

I should add that the realtor that I sent my earnest check to is friends with the realtor that was arrested with my identity. They both work for Edina reality.

I think you are going to have an uphill battle. You are going to have to prove that Edina Realty did something wrong. Just because this person worked there doesn't make Edina Realty liable. If someone is working at McDonald's and runs across the street and robs a bank, it doesn't mean McDonald's is responsible just because he was on the clock. In addition, it does not appear that you have any damages other than someone had your info on his id. That is not going to translate into much money.
