Do I need a divorce if I was only common-law married and never registered in court? We have been separated for over 11 years! I want to get married to someone else!
Answer
In a common law marriage if you have been separated for over 2 years then there is a rebuttable presumption that you were never married. The divorce would have had to be file two years within the separation date for the marriage to be valid.
