Entered contract (have signed, written document) for work to be done on my home. I paid 50% down. Three days before work was to start, contractor changed his mind.

Contractor mailed back my deposit in form of company check.

If I cash the check, will that affect my ability to sue for breach if another contractor does the job and it is more expensive? I hate to hold on to the check in the event that the firm closes up before this matter is settled...



Answer

You aren't entitled to the difference between this contractor and another if the second is higher. You don't have a claim for breach of contract. Cash the check and move on.
