My ex boyfriend and I have shared legal custody of my 3 year old son, but I have primary physical custody of him. He sees his father every other weekend. I have recently gotten married and moved from philadelphia to new jersey (in march) with my son and my husband who is military. In june 2015 he will be putting in his package for re-enlistment, which will take us anywhere in the US or maybe even overseas. My son's father agreed to the move to new jersey but has said he is going to fight the move next year. How can I ensure my son is able to go with us and how soon in advance should I petition for relocation?
