You can always ask for probation. Having the prior felonies, which are also theft/fraud related, will not help. What works to your advantage is often the State is more interested in getting restitution and so they will sometimes offer probation as a way to ensure that restitution gets paid.
It is impossible to know the pros and cons of going to trial without knowing the specific facts of the case. You should hire a lawyer to examine all the evidence in order to have a better idea of whether or not to go to trial, or by the very least, use it to negotiate the best possible plea.

Yes, you can go forward at the probate court even without his assent. You can file the petition with the court and you will receive a notice from the court that will include a "return date" - a date by which any objections must be filed. You wil also, as stated by Attorney Gorman, have to publish the notice in a newspaper. Her boyfriend being there may be a violation of the "lease", certainly her threatening you is a basis for a three day notice. She can drag it out for a time, depending on how smart she is. But if she is on probation for fighting, go to her probation officer to get him/her to warn her that she risks going back to jail.

Yes you can file a police report for stolen possession. Only the authorities can confiscate your personal property and even they oftentimes require a warrant to do so.
A citizen who takes your property has committed theft. He could have called the police (which is the proper avenue to resolve the dispute).
Be careful, if you involve the police you may be opening yourself up to charges if you were committing any crimes with your BB guns, but if your main goal is to get your BB guns back, file the police report.

Students implicitly agree to be bound by all the academic rules, policies and procedures when they matriculate. So if SJSU is following its own rules, her only hope is an internal appeal.

To be able to move out of PA, there are strict requirements that must be followed. First, a notice must be sent to him and the notice must comply with the statute. If he consents or fails to respond, then you can proceed with the relocation petition and the court should grant the petition. If he does not consent and he files a counter-affidavit, then a hearing will be scheduled where the court will look at a number of factors to determine whether it is in the child's best interest or not to relocate.

I have worked for a large insurance agency for the last 10+ years. About 2 1/2 years ago I was promoted to a commercial underwriter position. From the onset of my new job i had experienced animosity from one of the other agents in my section to include curt comments, rude gestures and an unprofessional attitude toward me. I brought this to the attention of my supervisor who assured me that he had addressed it. there was no anger or unpleasent behavior from my end at all (in fact i frequently told my supervisor I did not understand her distain for me). After that I had to bring it to his attention several other times until finally I did not feel as though I could remain sitting near her and requested that my supervisor move me to the other side of the section away from her. After i moved to the other side of the section she was given the responsibility of quality checking the work of the agents in the section (including my work). I did not want to cause undue burden on my supervisor so I did not immediately bring up my concerns with his decision and decided to trust that she would be professional in her new position. Whether it be the learning curve or her dislike for me there were several incorrect errors given (all of which i had overturned but did take time out of time i needed to be devoting to my job) after a large amount of incorrect errors I brought up my discomfort that he had her quality checking my work after knowing the problems that i endured with her. I advised my supervisor that I did not want to burden him with the responsibility of quality checking my work because i knew how full his plate was but that i was definitely uncomfortable given the circumstance and he continued to have her quality check my work. I have done my best to avoid any and all contact with her but she has still had whispering conversations right behind my desk , rolls her eyes when i speak at meetings and caused a divide in our section (with those close to her behaving unpleasent towards me as well) The offending employee, aside from singling me out, has had an intimidating impact on several other associates and has repeatedly offended myself and other employees with her anti-American comments (she is from Canada and frequently discusses her dislike for America). At this point I am fed up with having to feel intimidated by her and employees that have become friends with her. There is only one employee that is pleasent toward me and he (i found out just recently) was asked by one of my coworkers that is friendly toward her why he speaks to me.
In my close to 11 years experience in several different sections i have never had an individual create such an uncomfortable and intimidating workplace. In fact, in all the sections i had previously been in everyone was sad to see me move to another section (I am an upbeat pleasent person and generally the morale booster in my sections). at this point i am actively seeking other employment for many other reasons but i brought this to the attention of my supervisor manager and an HR representative and they basically stated that it doesnt matter because the majority of the offending occurences happened over a year ago and made me feel as though i were antagonist in this scenerio.
I am familliar with hostile work environment and that it generally applies to discrimination based on race, gender, etc. but based on all the information above do i have any case?

They are asking for Date of hire, time sheets, etc as if he was an employee. After contacting the man he informed me that he is sueing a company for injury and lost wages.
But he was never an employee. My father owns a glass and mirror company, he did the mirrors and reffered a handyman (the guy who is sueing,for injuries not related to any work referred by my father) too do the painting.

In Ohio, if there are problems around your apartment that your landlord won't fix, or if there are promises in the rental agreement that your landlord refuses to keep, then you can turn to the remedies provided to you in Ohio Revised Code Section 5321.07. This section says that if you are current on your rent, you can send a written notice to the landlord notifying him of the problems at the apartment. If the landlord has not remedied the problems in thirty days of his receipt of the letter (or a reasonable amount of time, whichever is sooner), then the tenant has three options.
First, the tenant can start escrowing the rent with the local municipal court. This means that you pay your rent to the court rather than to the landlord, and the Court will decide whether the landlord gets the rent and when (usually after proof of fixing up the apartment).
Second, you can petition the court to compel the landlord to make certain repairs. As a part of this petition, the court may instruct the tenant to escrow his rent. When the escrowed rent builds up to a sufficient amount, the court may instruct the tenant to make repairs himself and then reimburse the tenant out of the escrowed rent still under the court's control.
Lastly, if the landlord has not remedied the conditions at the apartment within the thirty day period, then the tenant can terminate the rental agreement and move out. Tenants should be advised that most courts consider this to be a somewhat drastic option, and require that the conditions at the apartment be extremely poor. You would be surprised at what some courts think a tenant should be able to put up with. Best to keep this option as a last resort, and never use it as an excuse to move out for another reason (like you got kicked out of school or you found a better place to live).
So the answer is not to just quit paying rent until the landlord fixes things. The answer is to follow the law. My sister did not find out that these were not her medications until after she had to be taken to the emergency room, were it was determined that she had had a stroke. After going to her own doctor a few days latter, they could not find the cause of her stroke. She was then fitted with a heart monitor. She wore this monitor for over three weeks. When going over some of the information, we learned that after about 10 days of taking this medication this stroke occurred. My sister took each of the 30 pills in these bottles, before someone from the pharmacy she takes her prescriptions to, came over and tried to explain to my sister how sorry they are for having given her someone else's prescriptions. My sister is in her 70's, but she has never had a stroke or problems with her heart before this incident. What can my sister do to receive compensation for this wrongful act by this pharmacy?

He(offender) feels as if the sentence was too harsh and I agree because it wasn't a fair trial. We have been separated for over 10 years and I want to get things finalized. The only paperwork I have is the partnership agreement we had and the insurance policy on the business which puts a value of $100,000 on it. My ex sold the business a few years ago and I had a friend of mine who owed me a favor (who was also a re-possessor and did a lot of work for the Sheriff's department) look into the matter. I have a signed note from him stating the business was indeed sold. I don't know if this means anything, but I recently looked on the state website for our business, which closed shortly after we separated, and found it being listed as still active. What does that mean and why would it be listed that way if it's been closed almost 10 years now.

That's impossible to say without knowing the terms of the lease and sublease.

Perhaps true, as Mr. Starrett answered, that one cannot be certain without reading the lease and sublease. However, I'd say that as a general rule, leases survive the death of the lessor or lessee. This follows the even more general rule that contracts survive the death of a contracting party unless the contract involves personal services. For example, if I contract with Picasso to paint my portrait, and Picasso dies, the contract does not allow his student or his executor to find someone else to do the painting. Somewhat similarly, if I die, Picasso is not bound by the contract to paint the portrait of my heir. However, most ordinary business are not for personal services -- and this includes most leases, especially leases of business premises. I'd therefore surmise that a court would find the contract is still valid and enforceable.

Just be aware that probating an estate can become complicated very quickly. The personal administrator can incur personal liability if not done property. I suggest you work with a local real estate closing attorney who also is experienced in probate matters. It will be worth your while to pay someone who can make sense out of the series of transactions and advise you properly. My impression from the way you phrase your question is that the estate representative is at least inclined to try to work something out. That is a positive, because I can see where this could have left you at a complete loss or in a position of having to spend a lot of money to try to protect your interests. It sounds as though you were purchasing the house under something of an "installment contract" or "seller financing" from an owner/seller that still had a loan on the house, when the owner/seller fell behind in loan payments and passed away. How do you know the owner/seller "lost" the house: if the installment contract or seller financing documents had been recorded, you should have received some kind of notice (perhaps a summons?) that the owner/seller was being foreclosed? It is also possible that the only reason the owner/seller's loan is in default is because of the estate situation. So there are many questions that should be answered with the help of a real estate/probate attorney.

To be safe, get the no administration paperwork from the probate court and pay a lawyer for an hour of consultation time to make sure the case was done properly (and to see whose name the court transfered the property to).

In preparation for the position I had to resign from my job at the time and spend money on equipment and processing paperwork. I expressed to the company that I had a court date that I could not miss and this court date would be during my training time. My training instructor informed me that the most time I could miss during training, which is 6wks long, is 4hrs. I was told by a HR rep from the company that I was removed from the training class and will not be able to reapply for 6 months. Limited liability companies are a relatively recent creation of statute, first authorized in California by the Beverly-Killea Limited Liability Company Act in 1994. It is codified in the Corporations Code as sections 17000 to 17656, forty-plus pages of fine print.
LLCs have members, managers and officers. Often, the capacities overlap, with the same person(s) being, for example, both a member and a manager. These participation categories are set up by law and the LLC's organizational documents will specify in which capacities your brother-in-law acts. The reason I mention this first is that the duties owed to the LLC and its other participants varies, with a manager apparently having the highest degree of fiduciary duty to the LLC and the (other) members. I'm assuming your brother-in-law probably hss the statutory capacity of "manager" due to his title, but not necessarily. The terms are defined in Corporations Code section 17001, subsections (w), (x) and (aa).
Corporations Code section 17153 says LLC managers owe the same fiduciary duties to the LLC and its members as a partner owes to a partnership and its other partners. Those duties are, in turn, spelled out in partnership statutes (Corporations Code section 16404, for example) and a bunch of case law.
Clearly, "misappropriation of business opportunities" is a major and fairly frequently occurring breach of the fiduciary duties of a partner (or an LLC manager). CC 16404(b)(3) says a partner must "refrain from competing with the partnership...."
A good business attorney could, after interview, advise you on the extent of injunctive and monetary relief the LLC might obtain by suit. Additional remedies such as expulsion of the brother-in-law are also very possible. Discussion of protecting the LLC's business methods by patent are somewhat beyond the scope of this answer, and my expertise, but I do think there is sufficient merit in that idea so that the other three LLC members should talk to a patent attorney.
The relative voting strengths of the four members, and any family or business loyalties that may exist, would be a factor in deciding what is practical and best for all concerned here, but some kind of lawsuit seems indicated.

my husband and i have been married for 8 years and the children are not his children. their ages now are 8 and 13 years old. the youngest has no idea she is not really his. we never told her any different. he is trying to purchase a horse park and write me out of it allmost as a pre-nup type idea. i told him i would not acfept that and what are we married for.he sounds as if he is just willing for divorce over this. and claims he has legalrights to the girls. Does he infact have rights.....?

If he lived with the 8 year old for the first two years of her life and has openly held her out as his own, then he may be the "presumed" father of that child under current law - NMSA 40-11A-5. Under the law prior to 2010, a man may be the presumed father if " the child is under the age of majority, he openly holds out the child as his natural child and has established a personal, financial or custodial relationship with the child." NMSA 40-11-5, repealed Jan 1, 2010 (note that there is not a requirement that he have lived with the child for the first two years, as in the current law). That could apply to both children as you say you were married before that law was repealed and the new law came into effect. He could possibly successfully claim to be the presumed father under either of those. It is a rebuttable presumption, however, meaning you could rebut it in various ways including identifying the biological father and using DNA testing.
As the presumed father he would have to go to court to get an adjudication of parentage and then he could have joint custody, also have to pay child support, etc., as any father would in the event of a divorce. The presumption of paternity goes both ways: it works for him if he's claiming "rights" to the child, or it works for you if you're claiming child support. Likewise the ability to rebut the presumption works both ways.
Re: the horse park - you can agree to keep the horse park his separate property but you don't have to. If he is buying it with community funds or mortgaging it then it will be community property and community debt unless you specifically agree that it is separate property. Don't let him buy separate property and have a mortgage on it where the loan documents do not specify that the loan is his separate debt. Community funds means any money he earned while you were married, unless it was income from separate property that he owned prior to your marriage.
Both of these issues (paternity and property) can get pretty complicated and you would be well advised to take all the documents to an attorney so he can analyze them based on the facts of your situation.

I got a loan from a payday loan company in 2004 when i lived in buffalo and failed to pay ut back because i lost my job at the time. But im being charged i. Georgia. Is this possible.

That sounds very suspicious. In order for the State to take out a warrant against you for bad checks, the creditor has to send you a very specific letter within a certain period of time. If you never got such a letter, and are only receiving phone calls, look up the law firm to see if anyone else has been scammed in this method, and do not pay anything. If they call again, tell them to send you something in writing to that you can take it to a lawyer to look it over. On the other hand, if this deals with checks written very recently, go and see a lawyer and give them the details to find out whether there are any steps you need to take to get rid of it.

Law firms do not contact you to tell you that bad check charges will be filed. That is not how the criminal system works. Instead, the police just show up and take you into custody. But for bad check charges to be filed, the person who received the bad check (usually a merchant) must write to you. If you do not pay then the district attorney will write you a letter if there is a worthless check program in the county. Neither of these scenarios involve a lawyer calling.
That is because real lawyers seldom call debtors unless they have a debt collection wing staffed by non-attorney debt collectors. The debt collection lawyers I know send a letter and if the debtor does not pay then they sue civilly. So I doubt very much that it is a real lawyer calling. It is a payday lender or debt collector impersonating a lawyer or its a scam.
Next time they call, write down the number and ask them if they are an attorney for their bar number and state of admission. If they give it to you, all states have bar associations and you can look up the lawyer. My guess is that if they are a real law firm or lawyer they will give you the information but they will probably hang up.
This might be a scam but more probably it is an overseas payday lender trying to scare you. First, payday loans are virtually illegal in GA and if the payday lender tried to press charges against you they might end up being the ones prosecuted.

I am not licensed in NY but I am willing to bet that (a) the statute of limitations has expired; and (b) that NY has a similar law regarding payday loans in that they are either totally illegal or else they come with stringent requirements; if the requirements are not met or the loans are illegal, the most you would have to pay back is the principal borrowed and maybe the statutory rate of interest. Further, you cannot be prosecuted in GA for a NY loan. If a crime was committed, it would have been committed in NY.
