I was living with a woman for 8 years and for the first 3 years she was married to someone else and she remarried in 2009 and was gone for about 2 months and I let her move back in with me on the grounds that she would get a divorce. We were living in my dads house and I left in July because she wouldn't get a divorce and got a job in anohter town. My dad let her live there on the grounds that she was going to do work on the house for her rent. That didn't happen. She has now moved out and moved furniture, Tv, washer, dryer and 4 saws. Some of this stuff was aquired while we were living together while she was married to someone else. The checking account was in my name and her check was direct deposited in my account. Can I press theft charges on her for taking the stuff out of the house without my permission or my dads permission? If not what is my legal right?

If she was married to someone else then you did not have a common law marriage in the State of Texas. In Texas, even if you were living together, you can only be married to one person at a time. Therefore, it does not sound like she was "available" to be in a common law marriage with you.

So the two of you were just living together. You co-mingled assets as roommates. Of course, now you realize this was a bad idea.

If she took "stuff" that did not belong to her, then you can try to get it back. You will need "proof" of ownership - like the receipt. The police and the judge is going to need some sort of proof that you actually own the things that you want back and that you claim you own. So you need to get written proof (ideally with the serial numbers) so that the items can clearly be identified. Otherwise, she can claim that she owns the "stuff".

You can contact your local sheriff, constable or police and ask how to proceed.

You can also go to small claims court and file a lawsuit against her. One way is civil and one is criminal. If you want the stuff back, then civil is the way to go. Of course, in the meantime, she can dispose of the "stuff" and it is gone. In small claims court, you can win and if she cannot produce the "stuff" you win a judgement which is a piece of paper. It does not mean that you will ever get any money out of her. (Many people win a judgement but never collect their money on their judgements in the State of Texas because Texas exempts a lot of assets from judgements -- so you might have to hire an attorney to try to collect & it costs more to hire an attorney than the judgement is worth -- but that is a whole new mess).

I would talk to your father before proceeding. Sometimes it is not worth going after her if the "stuff" is not worth much. You might be looking at a couple of months, money for filing fees at court, and time off from work to appear in court.

As a Franchise Attorney I can say the following. Most likely your only recourse is to sue them in small claims court, get a judgment, then hopefully collect on the judgment. Next time, collect at least half of the projected cost up front, then collect the other half when you begin the job. That way this won't happen again. If you are "under water" meaning the property is worth less than the mortgage balance, you can try to see if BOA will agree to a short sale. This would allow you to sell it for whatever the mortgage balance is if you can find a buyer at that price. Did you open an estate for your husband when he died. You could still do so and get yourself appointed as personal representative of the estate. If you did that, BOA would have to deal with you about the loan. You could also stop paying the mortgage and offer to deed the property over to BOA if there's no equity in it

I'm sorry you've had so many problems with your husband, but I'm glad you at least have your mom's support and steady employment and housing--those factors both help make your life a lot easier and should make getting good custody terms easier as well. You'll need to file a divorce petition, along with what's called a SAPCR ("Suit Affecting Parent-Child Relationship"), which will ask the court to decide custody, visitation and support, as well as determine various parental rights and responsibilities such as who can take your daughter to the doctor, decide her religious training, decide where she'll go to school, etc. The next step will be finding him to get him served or to file a waiver of service. If you can't do that, the situation will get more complicated and expensive, because if there's any possible way to do it, the court's going to require he get notice. Given that your daughter's well-being is involved, you really do need to have an attorney to help you figure all this out. The rules and law are more complicated than most people think, and one little misstep that you don't even know you're making can mean that you lose important rights for no good reason. Good luck--I hope this all works out well for you and your daughter.

You need to understand the difference between a voluntary and involuntary termination of parental rights.

Hopefully someone explained the difference to you in detail.

If the judge involuntarily terminates your parental rights, basically, it will "haunt" you for the rest of your life. It can be used against you if you ever have other babies.

But an voluntary termination cannot be used against you if you have other children.

It might not seem like a big deal to you now but that is a huge difference...so think a long time before you decide to change your mind.

Also, even if you decide to change your mind, the judge can still terminate your parental rights if the attorney for your children feels it is the best thing to do.

I assume that you had an attorney representing you. I highly recommend that you call this attorney and discuss your options again. Have someone explain what is going on again to you. I assume that the clock is ticking and the judge has to act on this case.

You can show up in court for the trial. You can talk to the judge and ask the judge to explain it to you. Hopefully, the judge will do it.

If the trial is coming up to terminate your parental rights then there have been some hearings and there is a statutory mandatory time period that the judge has to act. Right?

I also assume that you have been given over a year to do a lot of things by CPS and you did not complete your list of "things to do" by CPS - right?

I am sorry that they are terminating your parental rights. At least someone you know is adopting your children and not a stranger.

After doing research, I found the info on a infiniti forum where individuals had the same issue and they received a notice. saturday morning (Sept.5) I called infiniti usa and they stated they did indeed have an extension warranty on this issue on these year/make/model car. Make this short I was denied even though I had no acknowledgment of this issue. They stated that my warranty expired March of last again (no acknowledgement of the issue). Infiniti USA stated that the extension warranty expired on September 8, 2014 or 100,000 miles the day my car got towed in and was denied because my car had 102,000 even though I beat the deadline which was Sept. 8th, now they don't want to fix the issue and wasn't my fault and I had no idea the extension warranty existed in the first place. Do I have a case?

On the other hand you have a customer service issue where they could choose to say "we want you as a customer" or "we never want you as a customer." Call the corporate office and ask for a Vice President and stress that, and if they say no, simply never buy an Infiniti or Nissan again. You'll find out quickly if the company wants you as a customer.

I am self-employed with a fluctuating income (and since the economic downturn, a declining income); During mediation, my former spouse insisted on an average of the last three years net income to calculate the amount of support I owed (two of those years being pre-economic downturn). Recourse for what? We don't have your lease, but does it provide that the landlord is prohibited from marketing the property without your knowledge or consent? That would not be a normal provision. As far as paying rent, on what basis would you stop paying rent? What is the landlord supposed to be doing in the lease that he is not doing? Not paying rent would certainly mean you would be breaching the lease. The bottom line is that while you are justified in being diligent, you posted nothing to indicate the landlord is doing anything improper or in breach of your lease (which we obviously do not have). You can certainly hire a lawyer to read your lease and many will be glad to do it, but you can do it yourself. As far as the deposit, that depends on the lease, whether it was held in a separate account and the general financial condition of the landlord. That was the risk accepted when it was given and the lease signed. From your post, you likely don't have a right to get it back at this point and not paying rent would guarantee you would not get it back.

I had worked there for 2.5 years. I was threatened with termination by my manager several times without verbal warning for bringing to her attention illegal activity by a coworker, who was not a Certified Medical Assistant, but called in prescriptions like she was and other duties as though she was. She was never reprimanded for anything and she is colored . She wrote me up and then rescinded it because I filed a grievance against her. She then wrote me up again even though I was on approved FMLA leave for a migraine.

I filed with the Iowa Civil rights assoc. and it is currently being investigated since April. She told everyone in the office that I filed this against her with the Iowa Civil Rights.

Initially I was denied unemployment, they stated I quit for being reprimanded, but it was the culmination of the work environment and the wrongful disciplinary actions and sexual harassment.

I appealed the decision, an admin law judge also denied it, she barely let me state my side of the story and was very rude to me the entire phone call. I have since filed with the Employment Appeal board awaiting their review after I send in a letter , and I don't want to lose this one, so looking for some insight as to how I can win and overturn the decision.

I am currently a fulltime RN student presently.

Evidence is a tricky issue - not just evidence, as in documents, pictures, etc., but in whether it can be used in court. Several posts have been made about this, and the bottom line is that if it is an important matter, get a lawyer. Otherwise, get a PI who at least knows a little about the court procedures.

Each state has their own laws, so you should check with your local authorities. In my state, Michigan, this would be illegal. There are areas where the Department of Transportation has paved an "additional lane" onto the shoulder so you can pass stopped cars making left turns, but outside of this, it is illegal to pass on the shoulder.

The officer was within his rights to pat you down. But unless there is more to the story, he was probably only entitled to check you for weapons. Some paper and a small baggy could not have felt like a weapon, so finding them would not have entitled him to reach into your pocket and take them out.

Of course, he is likely to tell a different story. But even if he can show good reason to believe you were under the influence, I don't see how that would justify reaching into your pocket. That strikes me as an unreasonable, warrantless search and a Fourth Amendment violation.

This doesn't necessarily mean you can get the evidence excluded. The D.A. might argue that they inevitably would have found the drugs anyway if you had been arrested for riding while under the influence. Offhand I don't know how strong that argument would be. He might come up with other arguments too. But you at least have a very plausible claim that the evidence should be excluded.

You should get a lawyer right away. If you can't afford one, the court will appoint one for you. Discuss this issue with her, answer her questions, and see what she thinks.

I eventually moved out of state for work, then again to the north for family issues. I eventually located her and have been in constant contact with my children as well as spent 5 weeks with them last summer. I filed for custody as of last summer because of many things the children were telling me and the fact that they really wanted to live with me. Now fast forward to this date in time. Approx 2 weeks ago I advised my ex about my plans for summer visitation (as my parenting plan states I have 6 weeks), and waited a few days before I purchased plane tickets. Well once they were purchased, then she had an issue with the plans, and has now told me I cannot have them for the 6 weeks, but maybe 3 or 4. And definitely not when I wanted them, but when she determines is good for her schedule. Now being that I live in another state, will the court uphold her choice of giving me just a few weeks of summer and I would have to just eat the $1000.00 plane fare, or what? I am not sure what the court may or may not do and I am concerned. If I hjave to eat the ticket fare, I cannot go down to Georgia multiple times to get them when she wants me to as it costs me $500.00 just in fuel alone to pick them up and return them to my house, not to mention the time off work that I will loose.

Your parenting plan should state exactly who picks times, how long they are, and what notice is needed. Assuming you did all that (and you do not say if you did), and she doesn't comply, you have your lawyer sue for contempt and attorneys fees. If you made plans not in compliance with those provisions, you're in the wrong and you lose on the tickets. (I should note that I have never seen a parenting plan that allows a mere two weeks notice for a six week visitation, so my guess is you're in the wrong, but no one here has read the court papers). In other words you already have the answer in your hand but did not tell it to us.

If I were you, I would appear. If the other side has proper proof of service, they can ask for the temporary order to be made into a final order on the basis that you were properly notified of the hearing and failed to appear. It is up to the judge to decide what to do. Many judges or commissioners will decide that if you knew and did not show up, they are not going to bother giving you a second chance. I think most commissioners or judges will give you a second shot, just in case you did not know what to do or have some special circumstance, but I would never count on it.

If you are not prepared to go forward on the day of the hearing, most judges will appreciate it if you at least appear, explain that you need time to either find an attorney or to prepare your written response and to serve it on the other side and have a copy filed with the court. You'll almost always get a continuance that way to properly prepare.

Keep in mind that respect for the court (judges) is paramount. If you don't even do them the courtesy of appearing, that's an insult to he court, especially when the judge read the paperwork in front of them and took time to prepare for your hearing. By showing up, you tell them that you appreciate their effort, and respectfully ask for more time. You'll almost always get the benefit of the doubt that first time to prepare.

I have had my car stolen and apartment broken into because they refuse to put up cameras and our gate is constantly broken. I put in a complaint with the health department but then held off when the owner finally offered to come see my apartment. All they did was patch up cracks in my bathroom and primer my ceiling to cover the mold..now i have patches and paint splatters all over my bathroom that they are refusing to cover with paint. my bathroom looks worse than ever and there is still mold. even though they supplied the fridge they are refusing to fix it, and say theres nothing they can do about the termites and collapsing hallway floor. In the meantime the empty apartments have recieved new wood floors, tile kitchens, new counters and we got a new gate around the pool.. But painting my bathroom was not "in their budget". The owner, owners assistant and manager do not speak any english so I dont even have any way of reasoning with them..Should I get legal assistance?

I have been approved for the apartment but they are just requiring me to pay this off before I can move in. They have declined to provide me anything in writing outlining this policy. I have an excellent rental history for the past 3 years. I exceed their income requirements. And I am in good standing and up to date with all current utilities and other bills.

The statute of limitations is 4 years in my state. I contacted the utilities company to try to pay it off and they said the debt had been sold 5 years ago to a private 3rd party collections agency. I understand that settling with the collections agency may actually have more of a negative impact on my credit, and I don't see how an apartment complex can require me to do this.

To start, I always recommend that clients who are purchasing real estate with a co-owner have a property ownership agreement. The agreement should clearly state each parties' contributions toward the property and provide rules for selling a share of ownership. You mention that you had an agreement - was it in writing?

Secondly, you indicate that the house was yours. When purchased, was the house transferred into your name alone? Was your name on the deed? If it was, you cannot be evicted like a tenant. Similarly, the house cannot be sold without your permission, except by a court's order of partition by sale.

It may be too late for an attorney to help you, but you really should speak with one right away if you hope to salvage any of your initial investment.
