Under Arizona law, consensual sex between teenagers poses an interesting dilema, as ARS section 13-1407 states:

"F. It is a defense to a prosecution pursuant to sections 13-1405 and 13-3560 if the victim is fifteen, sixteen or seventeen years of age, the defendant is under nineteen years of age or attending high school and is no more than twenty-four months older than the victim and the conduct is consensual."

I hope this answers your questions as far as the ability to press charges. While you did not disclose your daughter's age, the question led me to believe that this statute applied to the situation. (ARS 13-1405 is the sexual conduct with a minor statute). You could still consult a civil attorney, but I hope this answer provides some clarity. If the borrower had not paid back the lender in six years, the lender has a statute of limitation problem. More than likely he could not sue more than two years after the default in payment occurred. If the borrower had paid him something over the past years and the last payment had been within the past couple of years, the lender could sue for the difference. Thus, the lender might have a choice of never having the possibility of collecting, or trying to collect something through a timely lawsuit. As to the burden of proof, the lender could see what the borrower has by way of evidence through written discovery (interrogatories, demands for documents, and requests for admissions). Perhaps the borrower has bank records that could show he withdrew certain amounts to make payments to the lender or kept a ledger of payments. It's always best to give receipts for payments made and retain copies of payment checks.

Obviously, getting current on your support obligfation will help your situation . Your next step is to file a Motion for a Change in Custody and Support. You will need to show a change i situation for the child, not just you or your ex. Since you have a warrant, you will almost suredly have to make your motion through an attorney.

First things first! I would strongly advise you to hire the best criminal defense attorney that you can afford to handle the criminal charge against you. In some cases an attorney can get the warrant recalled and vacated. In other cases (like one I handled this morning) the attorney is able to persuade the Judge to set a very low bond and then set up a "voluntary surrender" of the defendant who will have made arrangements for the bond to be posted immediately, and therefor in and out of custody in a matter of a few hours. Then, the attorney may very well be able to negotiate a plea bargain under which you will be placed on probation and one condition ofyour probation will be to make certain payments (current support and something towards the back support) on a regular basis. Once you have taken care of this, you will be in a much better position to seek a modification of the existing court order, both as to custody and as to child support. I handle both types of cases on a very regular basis, and I have been practicing for over thirty-three years Please feel free to contact me.

Yes. File a motion with the court, supported by an affidavit setting forth the relevant facts and circumstances and explaining why you are requesting the court order that you are seeking. The court filing must be in proper legal form, in compliance with court rules for form and style for judicial documents, and must be accompanied by the appropriate filing fee. Confer with the Court Administrator's office to arrange for a date and time for a court hearing. The arrange for a copy of the motion and affidavit, along with a Notice of Filing of Motion Seeking Court Order, to be served on the opposing party. It would also be appropriate to issue a subpoena to the kids' teachers, requiring them to take take off from school to come to court and testify as witnesses at the hearing so as to prove the mother's actions of taking the kids out of school for stuff like trips to the beach results in the kids missing quizzes, class work and homework and that they are falling behind in their grades ad that mother does not do anything to make sure they make up the work they're missing. And when you come to court, be sure to have a proper form of Court Order, ready for the judge to sign, the expressly details and recites specifically what it is that the court is ordering.

Yes and no. While some sources say it is based on a real person, it is not an autobiographical sketch, nor even a biography. It is a fictionalized account, although the author, poet James Whitcomb Riley, has said it was based on a true story, and the character first appeared in an 1885 poem. Years later, there was a comic strip about this character, created by Harold Gray, and ultimately, there was a famous Broadway musical play, "Annie."

James Whitcomb Riley has stated that he based the story on a little girl who came to live at his home in Greenfield, IN. Her name was Mary Alice Smith or "Allie" for short. When Riley first wrote the poem, it was entitled "The Elf Child." The character was "Little Orphant Allie." However, in a later printing a typesetter misread the handwriting and changed the "Allie" to "Annie." Riley at first complained, but his publisher told him that the edition was selling well and to just leave it as it was. So from that point on - it was Little Orphant Annie. (Riley's poems were often written with dialect, replicating the speech habits and patterns of the people he knew, rather than spelling their words correctly.)

Riley also wrote another prose poem about Mary Alice - entitled "Where is Mary Alice Smith?" This details the arrival of the orphan girl to the Riley Home, and how she would enchant the children with her wild stories of fantasy.

Is it a stretch to believe that the Riley family was the basis for "Daddy Warbucks?" Maybe - but Reuben Riley - the poet's father was the first mayor of Greenfield, IN, a lawyer, a former member of the Indiana Legislature, a Captain during the Civil War - and lived in a nice fine home - when many were still in log cabins. There is considerable evidence that this was the case of a poor orphan girl who had nothing or no one who could look after her. She was brought to the home of a wealthy individual who employed servants in his home (a cook, and a handyman) - as added help for his wife who would be alone (he being gone during the war) with small children. I believe this is the basis for a "rich" family taking in a poor girl. However, Mary Alice did not live long with the Riley's and then she left - her relatives seeking a place for her closer to them in their own community.

Mary Alice lived less than a year with the Riley family. She ended up marrying a local farmer, John Wesley Gray, and lived out the rest of her life in a small cabin on their farm - the mother of 7 children.

Riley did look for her later in his life - and she was "rediscovered" shortly prior to his death in 1916. She was confirmed as being the inspiration for the Orphant Annie poem - by the poet himself, and became a minor celebrity after that point.

If you have a PSA, and it was signed with a waiver of counsel and some other language indicating that the person signed it without coercion, etc., it should stand up. The next step, however, should have been the entry of same into a Final Judgment of Divorce, or, apparently in your situation, a Bed and Board Divorce. Since you indicated that an attorney prepared the PSA, you should discuss this with him/her.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Hi, I forgot I own an LLC and have not file taxes since 2008. My lawyer told me not to file because the State of California cannot come after me personally for the back taxes. They can only go after the LLC. Is this true?

The LLC has only one owner and it is me. It is still an active LLC according to the state website. No transaction has been made through the LLC since the inception. I simply forgot I have own an LLC and forgot to file the taxes.

The problem being that weekend is her ex husbands weekend with the kids. He only gets the kids every other weekend. She is the custodial parent. Also that is a holliday weekend, which means split custody for the day. About 3 mo ago, she let him know that we would be going on vacation that weekend, and if he wanted he could have the kids the weekend before, and weekend after. He had no problem with this. Recently when he found out that we were getting married, he has changed his mind. He is now saying that its his weekend, and he expects them to be ready on Sat morning as usual. My question is, can he do this, or what steps should we take to make sure we dont get introuble for leaving the state?

I agree with Bob. Unless there is cause, or someone in your immediate family will be occupying, termination is difficult, due to lack of housing supply. Most courts will allow a good tenant time to find replacement housing, and as long as the tenant timely pays the rent, the courts will shun eviction. I suggest writing now, informing tenant lease will not be renewed on termination, and hope that tenant will move voluntarily. ARD is great because you are not accepting guilt. Once you complete all that is required of you, your record will be clear. However, the 2 years probation is a little bit high. I would ask if they could get it down to 4-6 months, because until this is off your record it will come up when you seek employment.

You probably have a "life estate" in the property but a life estate is far to complex to discuss in this small space.

Plus, if he writes a valid will and leaves you the house then you have nothing to worry about.

However, you won't lose "everything" since you own 1/2 of the house and 1/2 of the community property since you have been married for 10 years.

Debt is a contract agreement with the lender. Sole responsibility for what was a marital debt can only be enforced if the lender agrees to the change. The Court cannot unilaterally change contracts in most circumstances. However, she can be held in contempt by the Court and ordered to pay the lender with interest. Consider carefully. Can she make payments? If she cannot then you may be spending money for Court and attorneys' fees with no ability to be repaid.

No you cannot send your mother to jail since the child support is not for you. The money is for your mother and it is designated for supporting you, the minor child. At 17, you are still considered a minor child.

I truly don't understand what you are referring to about "the card".

I assume that she cannot remember what she is doing & she is just mad -- it happens.

But what you do depends on what you want to do and what you can afford to do and how quickly you want things resolved.

If these debts are as small as you claim, then its unlikely (its not impossible but unlikely) that you would be sued as it will cost more than the debt is worth to sue. But if you want your credit cleared, then you need to think about paying sooner rather than later.

If you did nothing, the debts would eventually drop off your credit in 2018. If you want to restore credit and be eligible for future credit, then you need to decide whether to pay in full or settle. Neither is "better" when it comes to credit. If you can afford to do so, pay in full, but see if the debt collector will remove the negative item or change it to something neutral (like "pays as agreed." Technically, its not proper, but there are creditors who will do that. If you cannot afford to pay in full, when you have about 50% of the balance on the card with the largest balance, then see if the creditor will settle. Get a settlement letter once they agree to accept a settlement figure. Start at 50% - there is not a whole lot of wiggle room with very small accounts, but if its for credit cards and there is no litigation, they should not be demanding 60% or more. When you pay, do not give them access to your bank account. You pay by money order or bank check. And you follow up after you send the settlement letter within 30 days to get a closure letter indicating that the settlement was paid and that no further balance is owed and that there will be no further collection efforts and that the debt will be reported as "paid settled" or "paid collection." And keep a copy of any checks/money orders before you send them as well as a copy of the settlement letter and closure letter FOREVER. Debts have a way of re-surfacing.

Beyond that, once you get the debts resolved, you need to get yourself back on track. Its good that you readily admit you have a spending issue and I'm glad you are getting help for that. You need to prevent yourself from getting back in this mess. However, it helps your credit to have one credit card.

I suggest that after you get your credit cards resolved, see if you can get a stored value/pre-paid debit/secured card that will permit you to graduate to a real credit card in 1-2 years. Use the card only every other month to buy groceries or a tank of gas. When you need to put more on your card, you do. You cannot overspend as the card only allows you to access what funds you have put on the card so its more like cash.

After you prove to yourself that you can handle it, get a regular credit card with a small spending limit. Use it again every other month to buy a tank of gas or groceries. When you get the bill, pay the bill in full.

Your credit score is made up of mostly paying bills on time and how much credit you have available to you. Have no more than 1/3 of your available credit used up. It looks better for a person to have 3 cards with low balances than to have 1 card that is maxxed out. To learn more about credit go to www.myfico.com.

The calendaring of court dates is a complex process which involves, at minimum, coordinating three different attorney calendars (the Judge's, the Assistant DA's and the Defense attorney). Each of these participants can have hundreds of different matters on their calendars at any particular time, so finding a date which will work on all three is often no easy task. Changing dates once they have been set up is even more difficult. The judge does not even have the power to do it on his own but instead needs to give all other parties a chance to object to any proposed new date. This means that all three need to be on the phone to together or in court at the same time in order coordinate calendars. In other words, while it may be possible to change the court date, it is probably not worth the effort unless there is a true emergency of some sort. It is so much work that your boyfriend's lawyer would probably need to charge at least $500 extra to do all of this (drafting, setting up and serving a motion for adjournment, in addition to attending a special additional court date just for the motion which could involve hours of waiting time in court if the calendar is busy). For this reason, it is easiest to raise any objection to a new date while it is being set up in court, and for this reason, it is critical for everyone to have their calendars with them whenever they are going to court. She said that her son and my sister were having some sort of fight and that he was enraged and belligerent and refused to tell her what was going on so she told him to put my sister on the phone. She said she barely spoke witth my sister before he grabbed the phone from her and hung it up. The next morning when she went to see her son, there was crime scene tape and police everywhere and my sister was dead. So can I sue her or her homeowners insurance company for wrongful death being that my sister died in the home she owns and due to the fact she knew how violent he was that night and he knew they were fighting, yet she did nothing to protect my sister, she could've called the cops or went there to make sure my sister was ok but she did nothing. She was obviously aware of the danger he posed since she evicted his former wife in an attempt to spare her and the grandkids lives.

It is possible there may be a case somewhere here, but this case will be all about "duty". The defense will assert that you sister was not an unknowing tenant. Instead, she was the live in girlfriend of this man, which is a much different relationship than your sister simply being a tenant. That said, your sister could have, and probably would have suffered the same fate with this man had they rented an apartment in Chicago.

Another consideration is, while your sister's mother apparently knew how dangerous this man was, your sister knew as well, and that was the man she chose to remain with.

But that being said if the property owner's son is ultimately convicted of killing your sister than prior knowledge of his violent conduct might be a key issue even though her insurance company most likely argue that it/she cannot be liable (verses guilty) for the criminal actions of her son. A potential case for you and other similarly positioned family heirs may potentially exist enough to warrant further investigation but more facts will be required. I hope this helps.

Your sister's estate may have a decent case against the the boyrfriend's mother, but my guess is that it doesn't. The executor should consult with lawyers to see whether there is a case worth bringing.

In order to win such a case, the estate would have to prove that the mother owed your sister a duty to protect her from the boyfriend, that she breached that duty, and that the breach was a contributing factor to your sister's death. My sense is that she had no such duty, either as the suspect's mother or as his landlord. Even if she did, I think it will be hard to prove causation.

Your sister's death was caused by her killer, not by the killer's landlord (assuming that the killer was the boyfriend). Even if one person's negligence set the stage for harm to someone else, she generally won't be liable if the harm was actually caused by the intentional acts of a third party. That is not always true, but it often is.

There is a more fundamental question, though. Your theory seems to be that the mother should have evicted the son, and that her failure to do so was wrongful. Even if it was, that does not mean it played any part in your sister's death. Her boyfriend likely would have been just as capable of killing her if he lived somewhere else. The fact that he was living in a house his mother owned probably did not contribute to what happened. If I'm right about that, then the estate will have a hard time convincing a jury to hold the mother liable.

Even if the mother is liable, she will only bear a fraction of the responsibility for what happened. The jury would have to decide how much. The boyfriend will almost surely be assigned most of the blame. Let's say the mother was negligent and the jury says she was 10% at fault. The jury would have to decide how much compensation your sister's estate should receive, and would then enter a judgment against the mother for 10% of that amount.

These are just my initial thoughts about a very sad and complicated case. The executor really does need to consult with a lawyer in more depth than we can offer here.

I was told on Wed. this week that I would be going on permanent disability ( lifting no more then 20# ) for a hand injury I sustained at work in Jan. 2011. The injury was the tip of my middle finger on my left hand ( which caused a mallet finger ). I had surgery on it to reattach a torn tendon to try to repair it. While in a cast for about 10 days the other two fingers which also were in the cast ( my pinky and ring finger ) developed a large amount of scar tissue from lack of movement. My middle finger also suffered from the same problem. Soon after that surgery ( which still didn't fix the mallet finger ) I had another surgery to try to free the scar tissue from the middle finger because without the middle finger the other two won't bend properly. The second surgery plus hand therapy also failed. I now have three fingers on the left hand that won't work properly.

My company will now have an option of trying to create a position for me or just letting me go. Their insurance adjuster will soon be contacting me about some kind of settlement. My question is : I have no idea how much would be considered a fair amount. I would prefer not to get a lawyer to represent me in this if possible. I live in Florida

in case that means anything law wise. The doctor did put a permanent pin in the tip of the finger to keep it straight. Thank you for your time.

My son received a mild concussion while snowboarding. He visited his pediatrician on a Friday. The pediatrician recommended a MRI be performed if his condition deteriorated over the weekend. If his condition improved the MRI wouldn't be necessary. I monitored my son over the weekend, his condition improved, I canceled the MRI.

My X didn't agree with my decision and rescheduled the MRI. I informed my X the MRI procedure wasn't necessary and clearly stated she did not have my permission. I informed her via email and text, stating the procedure was not necessary and a waste of money. My X disregarded my legal right and had the MRI performed. Results came back negative just as I anticipated.

My X sent me invoices for the MRI procedure. The expense was significant. Am I responsible financially? Doesn't joint legal custody give me the right to say no to unnecessary medical expense?

I'm entitled to a tax dependant if I'm current on base child support. She'll withhold a tax dependant if I don't pay her for the MRI procedure. Can she do that? Would the MRI expense be considered a component of "base child support?"

Either way, you should take a copy of the power to an elder care or probate law attorney who practices in the county/state where the power is created or in use and pay the attorney to review and advise.

Since it is already April, the value of one month's rent may not allow for getting a lot of the opportunity costs (like lost profits, and moving, etc.) that you mentioned. Or, did you mean that you have a lease that goes to April of a future year?

Depends on where you live. In some counties, because of the court schedule, foreclosures can take a really long time, as can master commissioner sales. You won't be forced to leave your home until after the house is sold at the master commissioner's sale.

I would need to discuss your case with you in more detail. On any felony charge you are well advised to consult with an attorney before accepting any plea deals. It is extremely unusual for probation to be offered on a first degree felony charge - in fact I don't think I have ever heard of such a thing. On a first degree felony charge there is usually a presumption of many years in state prison upon conviction. I really think you need to speak to a lawyer before you go any further on this case. To answer your question, I will need more information, including a copy of the Will to determine the who is liable for the taxes.

On the accounting question, it seems like there is a stalemate....When that happens, in general, if the beneficiaries will not sign-off on the refunding bonds or approve an informal accounting, the executor will have to file an estate accounting in court and have a Judge approve it. If approved by the court, the executor is free to make the distributions without the direct approval of the beneficiaries. However, if the accounting is filed in court, the beneficiaries will have the opportunity to raise any objections at that time, and the Judge may agree that the executor has acted improperly and surcharge the executor or make other adjustments to the proposed distribution.

In NJ, the individual beneficiaries are liable to pay their own inheritance taxes, unless the will specifically says that all inheritance taxes are to be paid by the estate. The executor can be held personally liable if he distributes money to the beneficiaries and they do not pay the taxes. Therefore common practice is that the executor withholds the proper amount of inheritance tax from each beneficiary's distribution and pays it to the state. So if a beneficiary gets $10,000 and the will does not say inheritance taxes are payable out of the estate, the executor sends out $8500 to the beneficiary and holds back $1500 to be paid to the state. Remember these are NJ "inheritance taxes" you are talking about, not "estate taxes." The tax is on the inheritance, not on the estate.

Since you still have money to distribute, you should have the ability to withhold the proper amount of inheritance taxes from the final distribution and so reimburse the estate. Then those monies can be redistributed to those beneficiaries that would have gotten more money had the estate not paid the taxes for other people.

As for the 5 people refusing to sign the releases, find out if it is because they object to the idea of having to refund monies or whether they disagree with the accounting. It is common for beneficiaries to object to this, but they have no choice. It's a law. If they object to the accounting (meaning they think they are entitled to more money) you will have to do a formal accounting in the Superior Court. This entails much more than simply filing the informal accounting with the court.

Never do a final distribution to some beneficiaries but not to people who refuse to sign off. If those 5 force you into court, the estate will incur counsel fees which will not be assessed against their shares only. They will be assessed against the estate as a whole. If you pay the others, you will not have enough money to cover all of the counsel fees and you will have to pay legal fees that could have been deducted from the shares you paid out.

we have seen 2 snakes in 5 days and I pictured them inside and outside the condo. and i moved after one week upon found the another place to live, me and my kids are very scared and i still feel scared after we moved, I informed the landlord about that but she says that there is a damage in a door so she will deduct money from the deposit for that reason and also for cleaning but there were no damage until we moved. I want to get my deposit back .. we suffered a lot specially for moving out after 2 weeks.

we ended the contract with the approval of the owner and the owner gave me back the rest of the month and she sent me a termination of the contract due to act of nature after we asked many terminators that they confirmed that there is no way guaranteed to kill the snakes or to make sure they won't come again.

anyway all I need is my right not more not less and we didn't damage any door as she says
