Question

In the state of Virginia, if a couple resides in the same home but are not sleeping together and one spouse if the victim of years of spousal abuse is there a waiting period for a divorce and what is it if any?

Answer

In order even to file for divorce, the grounds must exist; they include adultery, cruelty, desertion and having already been intentionally separated for more than one year (six months if there are no minor children and there is a written agreement to separate. The grounds for divorce must be supported by independent evidence (not the other party).
