The A/C clutch is right on the front of the pump where the belt goes. If you were to remove the pulley the clutch is right under it if not part of it, but that's where it's hiding. All it does is connect or disconnect the spinning pulley to the pump itself so it can spin or not. They've very simple and shouldn't be too hard to replace, but sometimes the pump is a real pita to get to in some cars.

They used to call it "regular" and there was that and diesel until they decided the lead in gasoline was bad for us and started offering unleaded. If you have an old car from the days of leaded petrol, you'll probably have to put unleaded in it some time (unless you live in a country where they still have leaded gas at the stations). If you put unleaded gas in an old car, you can get a fuel additive to protect the engine from the harsher fuel. Over time, using unleaded in an old engine can cause some of the gaskets to dry out and start leaking. It won't hurt just one time, but it's an accumulative effect if you do it all the time.

Odds are you won't get a call back from a DA's office - if you do, it will most likely be a polite 'call a lawyer' responce. The DA is responsible for prosecuting you - their ability to help you is limited. Your best option is to hire an attorney in the county you got the ticket in to resolve the FTA for you. Another, less deseriable option is depending on what you were originally charged with, you may be able to just pay this off and move along. To see if you are eligible to pay it off you may want to try and contact the Criminal District Court Clerk's office in the county you got the ticket in. Be aware that simply paying it off may have consequences you are not aware of - better to be on the safe side an hire an experience traffic attorney.

I have pain in my feet because my feet are shaped funny. My doctor adviced me to get custom made orthotics, to help relieve the pain and help me get through everyday activities easier. I had orthotics before, but they didn't help. I told that to my doctor, but he advised me to try it anyways. So he made those insoles, they cost me quite a bit of money - a significant amount for my current situation - and I paid in cash.

The insoles ended up not working for me, they don't help solve my problem - they actually make my feet hurt even more.

Naturally, I would like to get my money back. (the product I purchesed doesn't work the way it is supposed to - makes sense, right?)

Dave....Sorry to hear about the run around you and your wife have been getting about her medical care and condition. It is still too early to determine what a fair settlement amount will be as your wife continues to receive medical care. Once she has been released from treatment, you will want to have a permanent impairment rating assigned by a competent physician.

The settlement value is determined by evaluating several factors which include: the total cost of medical treatment, any lost wages, the degree and length of the physical and emotional suffering, and the permanent impairments with which she will suffer. There can be other factors depending on the circumstances of the particular injury.

In a case this significant, I would recommend that you and your wife seriously consider having an attorney represent you. Adjusters are paid to minimize what they give you and certainly do not have you and your wife's best interests at heart.

We have to get an appraisal because we have a mediation scheduled. Her attorney indicated that both her and my sister will be present at the appraisal. I own this property solely. First and foremost, get yourself a lawyer. If the facts are as you state them your lawyer can probably shut this down relatively quickly. However, It occurs to me that one of the questions everyone will want answered, and the deed conveying the property to you should demonstrate this, is when did the transfer of property take place? Next, how soon after your father conveyed the property did he pass on? If you were living with him and he transferred the property one day and passed on a few days later - that's going to raise some eyebrows and the court will want some questions answered. If you are in court (probate or district) the other side can ask the court for permission to enter the property with the appraiser but I think I am on your side on this one. There is no reason why they should be entering the property. They are not appraising it nor are they there to influence the appraiser; and depending on what exactly is being appraised, if it is real estate (as you indicate) the appraiser can do his or her job without any of you being there. You may need to file a motion and ask the court to issue an order directing them to stay outside of the property when the appraiser shows up. Or, in the alternative, you can call the police if they try to enter your property without your permission.

In May of 2009 I sold a house to a person, I didn't use a realtor. Within the first 2 weeks after the buyer took possession of the house, she completely stripped out the entire interior of the house. The strange part of it is, there wasn't anything wrong with it. In Dec. of 2009 we received a notice that she was suing us, myself, my husband and my son. She claimed that she found mold in the house that we didn't tell her about and that we tried to hide it from her. She claims that she first noticed it in July of 2009, well after she ripped out all of the wall covering, ceiling and insulation in the house. The worst thing about the lawsuit is, she is claiming fraud among other charges, for a total of over $600,000. I sold her the house for only $135,000. I had an attorney until he dropped us because I could pay enough on his bill each month. Now I can't afford to hire another attorney and I nor my husband or son are able to represent ourselves. My question is if I lose the case and this person gets a judgement against me, can I keep my house and car, which I need to get to kidney dialysis. I know fraud charges are not dismissible if I file bankruptcy, so that isn't an option for me. And to make matters worse, the attorney that I had has threatened to file suit for the money that I owe him. My mane is Mary and I live in Pennsylvania. If you know of any organizations in Pa. that could help me, I would greatly appreciate it. Thanks

First, in order for the Plaintiff to prevail in the case, he and/or she must prove notice. As it seems that the alleged mold was something that was found when the buyers ripped down the walls, I don;t see how they could prove this crucial element of the case. Also to prove fraud, they have to come up with some really strong evidence that you knew that you had knowledge of the mold and deliberately withheld that knowledge in order to induce the buyers to purchase the house. Also, the buyer usually conducts a pre-sale inspection of the house, or hires an inspector to do this. Under the circumstnce, you cannot be held responsible for a problem you knew nothing about. I would look around for another attorney who might be willing to take on the case for much less then your previous attorney. Believe it or not, there are some attorneys who do have a heart, and might be willing to get involved for a smaller monthly payment. Finally, and I hope it doesn't come to this, should you file bankruptcy, there would have to be an actual finding of fraud, not simply a charge of fraud. Fraud is very hard to prove and unless you knew of the mold problem, or have documents pre-dating the sale of the house indicating the presence of mold, it is very unlikely that fraud can be proven. It sounds like you have a good case, and I would keep trying to find a lawyer willing to become involved. Were you to file bankruptcy, it would cost at least $1,000. I would rather see you spend this money on an attorney to fight this case. Finally, if you knew about the mold and did not disclose it to the buyer, you have a major problem, and that is even more reason to find a sympathetic attorney. You should go to the local bar association in your county and ask about lawyer referral. They may be able to help.

My ex is not a rational human, does not want this divorce, and has stalled it for all it's worth. He also has violated the temporary orders in just about every way imaginable.

When I asked for the temporary orders, I did not want extended spousal support (I realize how ridiculous that was now), and only asked for four months, thinking this would be over by now and I would be employed full-time by now (not realizing how poor the job market was). On October 14th, 2010, the judge ordered $3,200 a month for four months, beginning on October 15th, 2010. He never paid even one month.

I am wondering if it is possible/allowable to ask that the spousal support orders be extended since he has delayed this case so long, and if I can do it concurrently with the Motion to Enforce? If so, do I simply draw up the form with blanks for her to sign if she grants it and take it with me to court? Do I need to file something now, requesting it be heard concurrently with the enforcement?

You need to file a motion to modify the temporary orders (and serve it on Dad), and ask that it be set on March 29; otherwise, it isn't "before the court" and can't be ruled on.

And yes, you can bring an enforcement order to court with you. If you've never done one before, you probably won't do it right.

In Ohio, if you are in breach of the lease agreement, your landlord can file a forcible entry and detainer action (what most people think of as an eviction) in order to recover possession of the premises from you. The landlord can also file a second cause of action for money damages for the amounts due and owing under the lease agreement.

But the landlord must take steps to properly mitigate its damages (by trying to find another renter to take over your rental obligations as soon as possible). If you can show that the landlord is not attempting to mitigate damages, then that would be defense against any action for unpaid rent.

Whether your landlord will or will not do these things I don't know. Each landlord is different and has different policies and reasons for doing things. I can speak only in terms of possibilities, not probabilities.

The only thing insurance affects is that if you are uninsured you can't collect pain and suffering damages. But even that rule only applies if you own a car and do not have your own insurance. If you don't own a car and only occasionally drive other people's cars, even that rule does not apply. Only if you are required by law to have insurance because you either own a car or use a family member's car so much that you were required to be put on their policy and were not, does the pain and suffering limitation apply.

Whether you were at fault has nothing to do with whether you had insurance. So yes, you can sue the other driver -- or at least threaten to sue, which should be enough to get his insurance company to the bargaining table.

As Mr. McCormick notes, depending upon the facts, your lack of insurance might prevent you from recovering damages for pain and suffering. But even if it does, you will still be able to recover for medical bills and other out-of-pocket costs.

There appears to be no mistake or error on the part of the company that sold you the frames. I applied for OPT, received a EAD card but could not find a job and ended up volunteering for many places (food banks, animal shelter, etc.) that are not directly related to my major (Biochemistry). The EAD card expired on 08/07 last year. The bar to re-entry applies 180 days after a person's legal status in the U.S. expires. It is triggered once the person leaves the U.S.

If a person overstays for 180-364 days, they are barred from re-entry for 3 years. If they overstay 365 days or more, they are barred for 10 years.

You MAY be able to demurr if there is public record of you not owning the building at the relevant time. The trouble with a demurrer is that it only addresses the sufficiency of the pleading itself. So everything in it is assumed to be true for purposes of a demurrer. Only defects in the allegations themselves can usually be reached by demurrer. However, the court MAY take judicial notice of certain things. Public records are one such thing. So if, for example, you once owned the building and you sold it, you can ask for judicial notice of a certified copy of the recorded deed from the County Recorder. You are not likely, however, to get a judge to take judicial notice of an entire chain of title showing you were never on it. You would have to file an answer and then a motion for summary judgment to present that level of factual evidence. The place to start in any case is with a letter to the attorney who filed the complaint telling him you don't own the property and asking what proof he needs of that fact in order to dismiss you. Very few attorneys have any interest in wasting their time and their client's money chasing someone who they will never win against.

This is in the field of technology. It's like hiring a mechanic to fix cars, then once the guy starts working they tell him all the tools in the shop belong to the chief mechanic along with the smog testing machine, tire alignment machine, etc. and i'll need to ask him if i can use the tools. The guy feels his job could be threatened so he says "no", you cant use the tools. New guy goes to the boss bewildered and says,

"how can i do the job i was hired to do, with no tools"? and in addition i cant use my own tools while working in their shop. The boss says, Figure something out...?

New guy cant properly fix a customers car due to the situation, and he gets terminated. I used the auto mechanic analogy because it's something simple and clear that even a child can understand.

If i put it in a technical sense , the question would be harder to understand with the verbage etc...

But ultimately it's comparable to what i just endured with my former employer...

It seems pretty silly of the client to pay a consultant big bucks and then impede progress. Probably legal, though. In the future, the consultant may want to add a clause or two to his contract obliging the client to provide reasonable cooperation and otherwise facilitate achieving the agreed-upon objectives. You need to go to Family Court and file a custody petition. You will need to demonstrate why it is in the best interests of your child to reside with you over his father if you want to win residential/physical custody. If you want to secure full legal custody (which relates to major decision making authority), then you have to show a Family Court judge why you would be the better person for that as compared to his father.

Unfortunately, if your brother is the principal beneficiary of the petition, then, once he turns 21 or gets married, he will be bumped to a "lower" category.

I think you are confusing this with the Child Status Protection Act, which only "freezes" the age of a derivative-beneficiary under 21, in certain circumstances, when the principal-beneficiary is the parent.

I engaged a company online to obtain a Michigan auto wholesalers license for me, so I could legally resell autos purchased at auction in my state (NJ). I was told in the sales email that they would obtain the license for me, and I was to pay them a licensing fee ($450, discounted from the usual $500), along with an ongoing monthly rent ($300) for space in their Michigan facility in order to maintain the license, as well as an estimate of the associated annual insurance costs ($1800-2200). After paying the 'application fee', and signing the required credit card authorization form and attached lease (which didn't have a commencement date, and which I assumed at the time wouldn't commence until I received the license), I received a receipt indicating that the money was in fact applied to rent and deposit, not a license fee. And two weeks later I was charged another months rent, even before providing me with the initial license application! Then the insurance estimate they provided was twice the estimated amount($3450), and after shopping for competitive bids I discovered that I couldn't find a 3rd party insurer to even write that policy (with the licensed business address in MI and the actual transactions taking place in NJ). During this time they charged my card with another months 'rent', even before having submitted my application to the state. At this point I realized that this was probably a scam and notified them via email that I no longer wanted to do business with them and requested a refund, at which time they refused, referring to a clause in the lease requiring a 30 day written cancellation notice. I believe that they breached our contract by misrepresenting the associated costs, and attempting to provide a legally questionable and overpriced insurance policy that I couldn't obtain from a legitimate outside source, and therefore the lease I did sign should be null and void.

My question is: is my argument that the technicality of the signed lease be nullified, given the other circumstances of this transaction, e.g. that I was actually purchasing a license, and the lease was just a component of that transaction, which was never actually consummated, and also the deceptive methods employed to get me to sign said lease (discrepancy between the facts stated in the sales email vs the subsequent receipt)?

It sounds as if you have several good causes of action. I question even why you would need a Michigan wholesaler's license if you were not selling in Michican. If you think that the company has assets from which a judgment can be collected, call and we can discuss it. Meanwhile, you will probably want to stop the credit card charges.

The electrons that are forced in need a place to go, that will be a problem unless you sink your car into the ocean or bury it in the earth. Washing your car regularly is the best, keep it dry too. Rust just is what happens to old beasts.
