last February a lumber truck totaled my 2010 ford fusion, I had 3,200 in medical expenses, and liberty mutual/pip paid out to me 8k....my total loss was 19.5 know my lawyer said my case can only get me 23k (truck that hit me had a million dollar policy)...with lawyer getting 1/3 plus expenses(35%) which leaves me with 12.7 k...not happy, what are my options...pls advise

You can tell your lawyer that you want to take the case to trial. It is not the lawyer's decision to settle your case - it is your decision. That said, your lawyer probably wants to maximize the value as well. If you go to trial, you will have to pay back PIP the $8K out of anything you win. Do you think you will win $31K at trial?
