The most important thing right now is how you handle the case. Given the minor nature of the charge you should try to get into a diversion program (often called PTI for Pre-trial Intervention). If you successfully complete the diversion program the charge will be dismissed and you can then have it expunged. If you plea to the charge and get a withhold you can have the record sealed and later expunged. If you are adjudicated guilty you can not have the arrest sealed or expunged. You can contact the State Attorney's office ahead of your court date to ask about the diversion program.

You would serve him by publication. A notice is posted and published, and that's service. You don't have to know his address (a man can't force you to stay married to him by vanishing and not leaving a forwarding address).

Depends-currently the mortgage is the debt (240K) while the 90K negative just shows that there is a negative amount on the equity of the home. If the bank were to foreclose and sold the home for less then the 240k, the balance due would then become a debt.

Before you start suing people, start with the estate file. Go to the court in the county/state where your mother's estate was probated (this is where she lived at the time of her death or owned real property). See if there is an estate file. If so, then it is a public record and can be accessed by anyone. Review the will, inventory and accounting. Were there any assets or enough assets in the estate to cover any claims? If not, then this may explain why you received nothing.
If there were enough assets to satisfy the claims/debts and you were a beneficiary as specified in the will, then I would find a probate attorney and pay the attorney to review the documents and apprise you as to whether the estate can be re-opened or any other action taken against the executor. After this much time, I am doubtful if you were given notice and had the chance to object (assuming that the estate was in Pennsylvania). Pay the attorney for the consult and review - that way you will know whether you can proceed or not. However, this is not a small claims case and depending on what the attorney says and how miuch you were to receive it may not be worth pursuing. The only way to find out though is by securing the estate file and allowing an attorney to review it.

If an estate was opened, the Register's office will be able to give you information about the estate, including who the executor is. The executor is required to give notices to heirs, and to file reports with the Register's office.

I think what you might be asking is whether individuals who signed a nondisclosure agreement can reveal specific information to third parties to clear themselves of any wrongdoing.
If the information is to the authorities or to a legal body which is charged with oversight or investigation, you probably should go ahead because the information generally will not be distributed beyond what is necessary to investigate further.
However, if you are planning on contacting vendors and other clients or customers in your industry you could be subjecting yourselves to civil liability for revealing information.
I would have a lawyer go through the agreement to see what is covered and carefully word a letter to to the parties concerned to achieve the effect you desire without breaching the nondisclosure agreement.
That being said, sometimes it will cost you more not to breach it (in terms of reputation) than to stick to it (and get sued). Again, so much of this will depend on your careful judgment together with a lawyer's judgment about possibility liability (for disclosure and for not disclosing), it's hard to be general.

I am a New York State union employee who was promoted in 2007 to an Assistant Director position. I have yet to be paid for the promotion despite functioning in that capacity for the past 4 years. In my state, employees are assigned grade levels. This position was a 2 grade promotion. The method of obtaining the promotion was by reclassifying my item, thereby converting it to make it 2 grades higher. That meant there would be a period of time between when I took on the responsibilities and when I received the raise. Reclassification entails writing a justification document. It was portrayed to me as a mere formality. Typically it takes a few months to complete the process through the red tape. Once the process is completed, my item would have the new grade level and 4.5% raise to start. Based on the verbal agreement with the Bureau Director (there are no written contracts for promotions) and several witnesses, I agreed to take on the responsibilities while the paperwork was run through the red tape.
I have the following as proof of their intent and promise:
-email from my supervisor asking me to write the reclass justification myself, and she provided me with other documents upon which to model mine.
-email from my supervisor a couple weeks later requesting the document and stating that reclassifications are going through quickly at this point in time.
-the final reclassification document
-email from my supervisor, 1-1/2 years later stating my reclassification was the Division's highest personnel priority.
-document 3 years later showing my reclassification as needing to me done.
-outstanding performance evaluations detailing my work and showing that I am performing these duties.
-org chart from this year showing me in the position; the chart ties directly back to the reclassification document in that they both show the Assistant Director (me, though not officially having that designation yet) with the same number of subordinates.
-the 3 people that would need to have signed off on the reclassification, including the Bureau Director that first approved it, were embroiled in separate scandals that resulted in their forced retirements in 2010. They have not been replaced, presumably due to the economy.
Obviously I have been used. If I walked in and demanded to be relieved of these duties, the opportunity would permanently evaporate, though it probably already has. I am within 4 years of retirement. I have been performing these duties since 2007. One of my subordinates is the same grade as me and makes more money.
Do I have any legal recourse or standing? I would be happy with just getting the official promotion and money now. I wouldn't be looking for the $31,000, by my calculations, that I deserve in back pay for services already rendered. Also, if I live 25 years in retirement, not getting the promotion will rob me of at least $110,000. This has been emotionally and financially devastating.

If you informed the landlord that you have surrendered possession, removed all of your belongings, and just couldn't provide the keys, that should be sufficient. I would suggest explaining in writing what happened with the keys and your offer. Send it certified, return receipt, and keep a copy. Then, the landlord would have no basis to sue. If he doesn't take you up on the offer, that would be his tough luck. Your defense would be that you offered to replace the locks at your own cost, but the landlord was unreasonable.

No one has seen the papers to know. Something seems strange. If find it hard to believe that a sheriff would deliver a made up form.
I suggest that you go to the court which issued the writ and see if it is indeed on file. If so, you have to leave the property in 10 days unless you posted bond and appealed.
If there is a valid writ of possession filed, you need to speak with a local landlord tenant attorney or legal aid.

I purchased a horse from Zachary Chapman on 01/17/2014 for $1,000.The horse was supposed to be gelded and delivered to my boarding place by February 7th.
Zachary stated the horse lost one of it's testicles as a result of an accident. Turns out, the horse is a crypt orkid (meaning one of the testicles is in his stomach as a result of a genetic defect). Instead of the negotiated $200-$250 for the procedure, this will cost up to $4,000. The seller knew this all along. Once he informed me of the defect, I decided to withdraw from the purchase.
We signed a document agreeing to the terms. Zachary stated he was okay with returning my money. Since then, he has told me he doesn't have it and stopped responding to me when I followed up on his latest promise of sending $500 payment last week and another $500 when he has money.
I am looking to get my money back. Please help.

I am from CT. My friend had adopted a dog while living in Georgia. At the time she was in a relationship and has since separated. She has moved back to CT. She and her ex had a verbal agreement that since she would have to start over once back in CT, he would care for the dog. Once she was "back on her feet" he was to allow her to come and retrieve her dog to take him to CT. Now, (3 months after the break up) she is ready to take the dog back but he does not want to give him up. She has all of her paperwork proving that she paid for the adoption and is the rightful owner. Also, she has the pay stubs to prove that she is able to provide for this animal (and I hear about him every day and how she wants him back,.. the dog of course.) She was ready to drive down to get the dog but now that he has decided to try and keep him, I am not sure what sort of action needs to be taken to get her re-united with her puppy. I understand it was a verbal agreement that they had entered into involving custody of the dog but as far as owner ship, the adoption papers are in her name. Please help. We are trying to find a way to solve this without court. Is there any way to achieve this? I may have chosen the wrong category, if so please steer me in the right direction. Thank you for your time.

First of all since you posted this in the real estate area, you posted to lawyers who do house closings, so most lawyers who could have answered you in the correct category will never see your post.
If a person won't voluntarily act, she has three options:
(1) Give up.
(2) Hire a lawyer to sue for actual possession of the dog in Superior Court. The legal fees will be in the thousands of dollars and this will take a long time.
(3) She can file pro se for the value of the dog (not the dog) in Magistrates Court.
Bear in mind with no written agreement she has no proof so she may not prevail in Court.

However, he did not want to get the court involved, so i don't have an amendment to our existing court order approving the move. I recently applied for child support modification and he now is suing me for custody. Another issue is that our daughter is 16 and doesn't want to have to visit him. Since he still lives in CA, you cannot force a change of jurisdiction out of CA. You made a BIG mistake not formalizing your move with the courts. The only good news is that he has had 3 years to object to the move, which pretty much proves his consent even without any other evidence of it and the fact that he has only shown interest in the custody issue when you sought support modification is pretty clear evidence of retaliatory motive. The bottom line, though, is that you are going to have to deal with this in California and you will need a lawyer to deal with it.

I don't have gap insurance but it has almost been two weeks and I was not given a rental or any money. I'm a delivery driver full time and am losing money everyday. Actually, sadly, it is your fault. One NEVER should finance a car where they will be upside down without gap insurance. Your decision to save a few hundred dollars has cost you $4000.
The other insurer does have to pay for your rental until they tender the $4000.
The next car you buy, if you finance, get gap insurance. You can't fix this bad decision, but you can keep from repeating it. Good luck!

This is illegal under MD's child kidnapping statute and could be criminally prosecuted. You should contact the division of the police dept in your county that handles these kinds of cases and swear out a warrant for her arrest. A foolish one, I'm afraid. Until new legislation that went into effect 1/1/13, lenders in California were pretty much safe to do whatever they wanted during loan modifications. So your chances of success there are very slim. As for the attorney you would want to sue, none of the attorneys who were scamming borrowers about loan modifications were carrying malpractice insurance and the odds of them having any assets you could find to enforce a judgment are pretty much as slim as successfully suing the lender. In addition, by asking this kind of quesiton you pretty clearly say you don't have a lot of money to pay a lawyer. So you would have to find a lawyer who was willing to take a case with very little chance of success on a contingent fee basis - and that would be a very foolish lawyer.

But, I didn't file a Declaration In Support of Opposition of Demurrer with it. I know a Declaration is optional, but I wanted to file it along with the opposition.
My Question is, if I file a Declaration a few days late, past the 9 court days before the hearing deadline, will the Orange County Superior Court still accept the late filing of the Declaration, or will they consider the Opposition late, since I filed that Declaration a few days late, even though I filed the Opposition (only with the 2-page Opposition statement & the Memorandum of Points & Authorites) on time.

Your declaration would be untimely, so the court would not have to consider it. Some courts might consider it anyway.
But if your opposition itself was filed and served on time, trying to add a declaration will not make the opposition untimely. The declaration would be the only untimely filing. The court would have to consider your opposition whether it accepts the declaration or not.

Who told you to file a declaration? A demurrer is based on the legal sufficiency of the pleading it attacks, not evidence in support of it. If your pleading is insufficient, you need to be pointing out to the court how you can amend your pleading to make it sufficient. You have given more details, but they are not that helpful. In general, whether the additional language is above or below the printed form language does not matter if it is intended to be part of the contract. If it was added after the parties signed then it might not be binding. That there are different stipulations does not matter, except to perhaps show there is no contract because the agreement is too vague for a meeting of the minds.

I received a call from my tenant on January 23 alleging damage to their furniture as a result of mold. I immediately went to the home and found no evidence of mold anywhere in the home. They demanded that I pay for their furniture and stated that this had happened to them in the past and the previous landlord had paid for their furniture. I told them I would get a mold inspection. Seven days later on February 1 they refused to pay the rent and said they were entitled to withhold rent until I "fixed" their problem. I filed an UD and their response is serious habitability issues, retaliation, harrassment and failure to make necessary repairs. These people never requested repairs nor did they give me anything in writing alleging these issues. It was all about their furniture and not about the home. Everything they are claiming is untrue. What possibility do I have of winning this case if we go to jury trial?

I am unsure whether the court will allow a jury trial. These tenants are professional litigants. So you must prepare your self very well.
1. contact their previous landlords and see what helpful information they can provide, including that the furniture they claim was damaged was the same furniture they claimed damaged before [you can argue in part that what proof do they have that the mold had not been entirely killed off and did not just return from the original infection; also you are trying to show the trier of fact that they pull the same scam with other landlords].

2. Their refusal to pay the rent is illegal; a tenant can withhold up to a month's rent actually paid for repairs if the landlord after reasonable notice fails to do so. They did not spend the money on repairs, etc. Mold does not just develop on furniture; where do they claim the mold is coming from?
3. it seems that most of their defenses are bogus, but judges tend to be very pro-tenant so you can not be overly confident. You probably want to prepare a written brief for th judge pointing out why some of the arguments can not be raised, or are wrong.
4. To get a jury, they have to put up jury fees, which they will not do.
5. Are they still in your property? Do they have any assets? Does your lease with them provide for attorney fees?
It would be worthwhile for you to consult for an hour or two with a local real state/landlord attorney.

Originally custody order in April of 2012 listed no adult of the opposite sex could spend the night. (we were still married at the time, if that makes any difference)
Custody order modified in May of 2013 this matter wasnt addressed specifically, it said that previous order still stands except where modified.

December 2 2013, filed a motion to amend order to have that taken out, mid December I received my filing back from the court, along with a letter from the clerk stating that it wasnt a stipulation of my order.
December 23rd began staying the night with my boyfriend (both at my house and his)
March 1, said boyfriend and I moved in together
March 6 I received a show cause from my ex stating that I violated custody agreement
March 26 Court, I provide documentation to the judge showing where I tried to file, and response from court. He finds me not guilty, but states that it IS indeed still part of the order. I then explain that we have moved in together. Ex demands my BF has to move out, judge says he is not "unringing that bell" at this time, and will now hear the motion to amend/will have it placed on the docket. but that my BF can stay. (says its possible he will order him to leave, but not until the motion has been heard)
We have court the 23rd.
But we have been in the same home for 4 months. My kids are accustomed to him being there and depend on him.

However, as a general rule if you are waiting a response to subpoena the case is not final and the award of attorney fees would be an interim order, which would not cut off future conduct in the case. You dont explain what lost your payment means. You lost the cash? Problem is yours. Lost a check in the mail, you may have defense if payment is made through the mail. An eviction is proper if payment has not been made. Only defense is payments. As for the $600 fee it can be negotiated, but start by paying the rent or the situation will get worse and and more costly.

If the problem is solved by this you have two options. Go to a parts store and buy ground straps to replace the two temporary wires and the problems should stay "solved", or better yet, go to a mechanic and have him do the job.

First, as suggested by Attorney Davidson, seven years and no divorce is asking for trouble. If you are no longer with your spouse and have no intention of reconciling, then while you are still alive, file for the divorce now instead of waiting until the first one of you dies and creates a bigger estate mess that will cost money and lawyers to fix.
Divorce law is concerned with the divorce, alimony/support of spouse, child support/custody and division of marital assets. With regard to assets, the divorce court is concerned mostly about marital assets. So their task is to see what you and your spouse own, classify it as being acquired before, after or during marriage, value it and fairly or equitably divide it. Anything acquired after the date of separation may be considered as separate, but it depends on the asset, how it is titled and whether it has gone up or down in value and if both spouses continued to pay for maintenance, taxes, and mortgage. If not, this will all have to be accounted for so as to arrive at an overall equitable distribution. Equitable does not mean 50-50! It can be 70/30, 60/40 or something else depending on the circumstances, which you do not relate.
Whether you can get a portion of your share of the home and household goods depends on a lot of information you do not relate. You may not get the actual items but may be credited with value. With the house, it depends on how it is titled, but if your husband is living there, the court will probably require your husband to buy out the equity value of your share. Again, this is just speculation - I don't have any information about debts and assets and that is why you need to see a family law attorney because there may be some information that I don't have which would change my advice totally.

A gift of a new dress would be separate but gift of a new washing machine is probably marital. It depends on the particular item. You need to talk to an attorney that practices in your county and knows the judge.
I don't know all of the facts. So I'm just going to make a guess. I can make one assumption-- you are not going to like my answer!
What the judge is going to look for is what is the best for the child. What was best for the child was the an intact family. Well, that is no longer the case. So now, it is having 2 parents in the same town. Having both parents available in case the child needs one of you in case there is an emergency -- not one of you 5 hours away in case there is an emergency.
The judge is going to consider what is best for this minor child. What is best for this child is having BOTH parents involved with this child. Moving this child away from his father is not best for this child. Therefore, if the father is involved in the child's life the judge is probably not going to allow the child to be moved 5 hours away since it will make it harder for the father to see the child.
If you marry, however, YOU can move away. You are NOT prevented from moving. The only person prevented from moving away is the minor child.
Your child is not going to be moved just because there is a change of circumstance in YOUR life. It is harsh -- not really because this child is a product of both of you. The change of circumstance is in YOUR life.
You need to continue to co-parent with your ex-husband. You produced this child together. You will be co-parenting this child together for the rest of this child's life.
You have JOINT CUSTODY of this child. In the State of Texas, JOINT CUSTODY is PRESUMED BEST FOR THE CHILD. In reality, neither of you will ever have "full custody" of this child. I have no idea what you mean by "full custody" of "my son". You should refer to this child as "our son". He does not belong to either of you -- he is a product of BOTH of you.
Now that I've totally depressed you. You might make the father an offer an "offer he can't refuse" in order to get him to allow you to move. For example, you might offer to do all the driving or to lower his child support a lot in order to allow you to move away.
Or, you might consider going to mediation in order to try to resolve this matter instead of going to a judge. Often a mediator can find a "creative" solution to this matter instead of a judge.
If you want to move away you might have to find a way to "sweeten the pot" for the father -- like more time in the summer or every Christmas or every Thanksgiving or giving the father something that he wants that a judge could not give him. Perhaps you could make this a "win-win" situation for everyone. But, be sure to get it in writing so that it cannot backfire on you later!

I am a concession food vendor out of katy tx, who was working with a man who was suppose to find events and festivals for me. He had other vendors who he had signed on to help. I gave him a deposit for the booth rental at the event, but then he called me and told me he had canceled with the event director. He told me and other vendors that it was do to they were not doing there part to advertise the event. I found out that this was not the case, the man that I was working with pocketed the vendor money and never gave anything to the event coordinator for booth rental. So far we have seven vendors he owes money to. To rent the booth was 300.00 for each booth, plus I found out that he owes other vendors from another event. He finds events tells vendors they will work for him, he gets there money and then doesn't follow through once he has the money. I do have a contract which he breached. Could this be a legal matter. The other vendors which I have talked to what to stop him from doing this to other vendors, can we have him arrested?

It would be criminal if you could find an interested police officer - but that is not likely. More likely, if you call the police they are going to tell you that it is a civil matter and to sue the guy to get your money back.

I hired a contractor to redo my outdoor balcony in June. In August, my electricity went out and ComEd came out for the repair. They claimed that the contractor had damaged the underground cable wire, which caused the power outage. They proceeded with the repair.
I received a bill from ComEd for nearly $12,000.00 for their repair services. My home insurance agent told me that they do not cover any damages outside of the house. I did not have a formal contract with my contractor, however, I do have a signed receipt to prove that he had worked on my balcony. I had contacted my contractor in regards to this situation, but he had said he does not have insurance to cover this bill either. I trusted him only because he had worked on my neighbors balconies, at least 5 other houses, without any issues. So, does this mean I am responsible to cover the entire $12,000.00?
I was never made aware that I would be responsible for the charges associated with the repair, nor was I ever given an estimate prior to the repair. I feel it is unjust that I should be responsible for such an exorbitant amount. I am a retired senior and feel it is impossible for me to pay such a large sum. you need to contact a reputable lawyer in your community. most initial appointments are free. at that appointment make sure you bring your homeowner's insurance policy, the bill and any paper work from com ed and the contractor. just because your insurance carrier says there isn't coverage doesn't necessarily make it true. similarly with com ed - just because they say... doesn't make it true. your lawyer may need to litigate the matter by having the contractor, com ed and the insurance carrier as parties in the case. good luck but eventually you may not be held responsible for the bill. it will probably end up costing you money for the lawyer and costs but it might be well worth it. good luck.

NY law does not dictate, but the Contract of Sale usually includes a clause that the purchaser occupies the premises after closing. Seller can prepare a post occupancy agreement that both parties would have to sign in order to allow the seller to remain in possession of the premises for some period after closing. You should discuss this with your attorney in order to insure you are properly protected.

My girlfriend was convicted of a felony for writing bad checks. She was in an abusive relationship at the time, and her partner coerced her to open a checking account and then proceeded to write checks in her name until my girlfriend was arrested and charged. Jail time was suspended as long as she paid her restitution and obeyed her probation stipulations. At a couple of points she ended up breaking her probation, ended up serving state prison time and still had to pay off the remaining restitution after her time was up.
My question is this. This all took place between 1999-2004, in Texas. This felony charge follows her around and it's incredibly difficult for her to find a good job. Is there anyway to go back and reinvestigate the original crime and have it overturned? If not, how can we proceed to get this off her record? Is there anything we can do?

She can consult with a lawyer about doing a post conviction application for writ of habeas corpus but it does not sound like there is a basis for it. There is no other way to get it off her record or sealed.

Your neighbor may have rights, depending on the situation to cut back portions of trees which are encroaching upon or over-hanging his property, especially if they are near his roof. He doesn't have a right to do that with respect to growth that does not adjoin his property. If he was wrong, damages would be the value of the trees that were cut, assuming that they were of a valuable type of tree. Take pictures of the cut trees and property line and consult with an attorney to see if you have any recourse.
