If I wasn't personally involved in this case, I never would believe it in a million years. I reside in Arizona. My son was given temporary legal custody of his son (my grandson) due to the mother's mental health issues and negligence of the child. The child was taken away from her twice by child protective services. The mother obtained an attorney... a well-known woman who was recently disbarred for fraud) and filed the actual legal custody hearing in family court. My son went to the first hearing pro per, as he felt that the mother's mental health history and history of five involuntary committments to a psych unit over the past two years would speak for itself. The judge ordered that temporarily, the mother could have supervised visitation and my son retained physical custody with final say. I loaned my son the money for a retainer and we picked an attorney out of the phone book. The two of us met with her for almost two hours and retained her based on the things she said she would and could do. My son was seeking full legal custody and child support. Despite the mothers mental illness, she maintains a full time job. We went to court expecting to be witnesses for my son and as we stood to be sworn in is when we found out we WERENT testifying. My son's attorney never submitted any witnesses for him! And it only got worse from there. I have never in my life seen such embarrassing behavior from an attorney. She presented none of the evidence we provided, called in none of the CPS or personal witnesses, and failed to provide the judge with any concrete information, short of handing him the mothers three inch thick mental health records and telling the judge "I suggest you better read all of this before you make your decisions". The judge was obviously very irritated by my son's attorney and frustrated. Two days later we learned through public record look up that my son practically lost everything. The mother got joint legal custody, three weekends a month unsupervised visitation, and alternating holidays. The judge declared she was mentally competent to parent the child (despite being released from an involuntary mental health lock up just 1.5 months prior to the hearing), but then stated he is not awarding my son child support due to her mental health issues! He even has to pay 1/2 the transportation for visitation 7 days a month and she is awarded to claim the child on taxes every other year! I am beside myself. My grandson has been neglected before and per her history of hospitalizations, she becomes psychotic and is hospitalized about every six months. We are at a loss. I really need some advice on what can be done. Can family court in Arizona be appealed? The judge did not have all the necessary information to make an informed decision and he obviously did not read the mothers medical file. Also, I know I can make a complaint to the state bar, which I will be doing, on our attorney, but we need to have that money returned before we can hire another attorney. In the meantime, my grandson could be in danger. We are really at a loss and would appreciate any help. Thanks again... concerned Grandma

If you came from MD and you return there, MD will have jurisdiction over the child if you file for divorce there. If your husband concurrently files in CA, the CA courts will abstain from exercising jurisdiction - provided you ask them to in a properly prepared motion. She was arrested and spent 2days in jail because of this clerical error. The judge apologized gave me a letter admitting clerical error and instructed the dept of motor vehicle to reinstate her license at no charge to us. I was told when the clerk scanned in the speeding ticket to be cleared, they failed to clear the seatbelt ticket which resulted in the arrest, warrant, suspended licence. My daughter is a 20 year old full time student, works, and volunteers in the community, oh and never had legal issues. The treated her horrible. When I found out she was in jail. I started at 7am calling the jail.and I did not talk to her until 4pm . omg.. rude is an understatement. Long-short is it a possibility she can recover damages for her wrongful incarceration.

It is important to remember, when talking about Norman social organisation, that both in Normandy and in Britain after The Conquest the 'Normans' as we think of them ie. cavalry bound mail clad warriors, tended to form the ruling elite. It wasn't that they were somehow a whole people separate and above the native population who were known as the 'commoners'. It is largely because of the top heavy nature of Norman social reportage that the lower classes were ignored. The 'fleeting' supremacy of the Normans left little time to dwell in literature on the people who supported the system. To enable such a professional warrior class, there had to be a culture where their none productivity had to catered for by excess production of food. A situation that applies to all societies that possess a standing army that needs feeding. They had their own terms for these lower ranks. In broad terms they are: The lowest of these ranks were the landless Serfs, bondsmen who laboured or looked after animals, approximately equivalent to a Saxon theow. Above the serfs were the Villeins, freemen who were tied to their lord's land, equivalent to the Saxon gebur. Next came the Cottars, men not tied to the land but expected to work for a local lord for one day a week, equivalent to the Saxon kotsetla. The highest of the 'non-military' ranks were the Freeholders who were not tied to a lord, much like the Saxon geneat.
Of the 'military' ranks, the lowest rank was the Sergens, a professional footsoldier, literally 'one who serves'. Above the Sergens was the Vavasseur, a soldier who equated to a squire, and who would have probably served a particular knight. The knight or Miles was the lowest of the military elite, a well equipped and well trained fighting man similar to the Saxon thegn or huscarl. Over the Miles was the Baron, the lowest rank of the nobility and a senior knight. Above the Baron was the Comes, or count, responsible for a whole district or county, much like a Saxon eolderman, and directly serving the duke. Before the conquest of Britain the highest rank amongst the Normans was Dux, or duke, and the title' of Duke of Normandy' was held by the English Kings from 1066 until 1204.
The term feudal is often associated with William and the Normans, suggesting a system whereby a tenant or vassal held land from the King or his superiors or Lord. In return, he was expected to render certain services or even military service. The term of such land holding is called 'fief' literally meaning ' in fee', a system of land holding that was popular throughout Europe until the end of the Early Middle Ages. The arrangement was such that as time went on, elements of these obligations of land tenure became more complex to include terms like 'feudal incidents', one of which is called a 'relief' which was the duty paid when a previous tenant had died. Often, the obligations were by and large commuted into cash payments, so that no physical liability took place, in effect becoming the start of regular rent payments. This in turn forced the troops that were up until that point semi professional with other responsibilities into truly professional troops.
With the conquest, most of the land previously held by the various Thegns and Eorls was confiscated and placed into the control of the Normans and their Flemming allies. This in reality placed all this land under the control of the King, however, William only actually owned directly 15% of the lands, whereas a smaller group of wealthy Norman families and his 'Tenants in Chief' held 50% of the estates. By 1086, only two English Thegns still held land through the King. The Norman estates in England were often supplemented by estates held in Normandy as well, inflating the wealth of several key Norman families and those linked with William. These families were to become major players later on in the development of Norman England.
As reward for service, William granted estates and parcels of land in the form of 'Honours'. Rather than being a single unit, these were usually scattered plots with a central point called a 'Caput' from the Latin, where we get the term capital. At this point, a castle was created for the Lord to reside, and to control his estates. The honours numbered 170 or so, with the smaller estates which were no big enough or important enough to be called honours, deemed to be 'Manors'. If the land of the manor was cultivated by the Lord, it was known as a 'Demense', even if it was cultivated by local tenants, again in return for rent or duties. In every estate, the system of obligation to your social superior stood, with the Serfs at the business end.
The division of land by William to the various ruling Norman families helped to spread them apart, which was considered to be a political move on his part to control them, but is now seen as just a continuation of a Norman practice that was current in Normandy. Strategic areas such as coastal ports, beaches and the borders with Wales and Scotland had key blocks of land allocated rather than the scattered system he previously employed. This again mirrors practice in Normandy with the 'Compte' model, and this method became more entrenched as time went on, with William handing over more land into the grip of Normans whom he trusted above prior Anglo-Saxon tenants, Bishops and Abbots. Each of these areas of land controlled by his 'Tenants in Chief' ensured that sufficient men at arms were available for William, and it has been estimated that William could in times of crisis call upon the services of 5000 knights to serve in his army by this system.A Nomam knight from the time of the first Crusade
The Knights themselves were divided into two categories. Firstly were the household knights, who resided with their honourial lord and rode with him as he went about his duties on his estates. The other group of knights were the 'enfeoffed' knights, who after a period of military service were granted land, and then continued to serve or paid rents or rendered other services to the King. The King's tenants of William, also created knights of obligation under them, and in the process created other problems for themselves as their own miniature private armies grew, as the maintenance of knights was not cheap. In later years, these miniature armies under the poor governance of weak Kings such as Stephen and John began to vie for power with each other in a period of real instability which England hadn't seen for hundreds of years. The effect to begin with was to ensure that the king was able to call upon a large professional army to shore up any question as to his right to run the country. Even William was not foolish enough to do without the system of hiring in assistance in the form of mercenaries. Post the Battle of Hastings, there were many men to be had for 'geld', just as there had been under the rule of the Anglo-Saxons. To ensure that there was sufficient to pay for such help, taxes could be levied to offset the expense of mercenaries, and in the latter days of William's expeditions in Europe, he had to levy some of the heaviest taxes that the nation had seen, which was never popular with the general populace. He could also employ the services of the Fyrd even then, as semi professional troops, just as had been the case in Harold's day, which could swell the ranks of his field armies by tens of hundreds.
There were notable exemptions from the honour system known as 'book land'. Under the auspices of the Church, land could be held free of the responsibility required by ordinary folk. Owned by Thegns, this land could be held as long as certain duties such as fortress construction or maintenance, equipping ships, and guard duties were carried out. This ensured that the Thegns retained their status though, rather than their tenure on the land, making a subtle difference to that of the duties of Williams tenants in chief or vassals.
We have not yet addressed the term Feudal. The reason for this is that it was coined in the 17th century to describe the state of play in England during Williams reign and the Medieval Kings who reigned after him. This term was used from the visual reference of the 1700's, and not during the Norman Conquest, for the simple reason that the subtle governmental system that Harold II had used and as his predecessors had done was unknown. It was historically expedient for 17th century historians to place an unfavourable social cut-off at the point of the conquest, which in fact was just the transfer of power from one social class to another albeit foreign one. The mathematics of it simply reflect this. Even with a conquering army of 7000, and a semi professional army of much the same opposing him, William could not wipe out thousands of farmers and the ruling classes. The change of rule may not have been all sweetness and light, but one good boss was just the same as another good boss, or even a bad one for a bad one.
With the greater understanding of Later Anglo-Saxon culture, it's now fairly clear that the Normans should not be viewed simply as the evil and oppressive overlords of Robin Hood fame (a view which has more to do with the anarchic times of Stephen, John and Richard). Duty and obligation was the method the Saxons had used for hundreds of years, and this too was the system that the Normans employed. This meant that the Anglo-Saxon cultural system was easily able to absorb the new Norman social classes, so much so that not even the Norman language was adopted. William was just as likely to send in a force of men to quell any rebellion, as Harold would have done, he only really exceeded Harolds temper in the destruction of farmland and stores as in the 'Harrying of the North'. It is improper for this woman to sell her property to someone else without violating the due on sale clause. If the mortgage lender finds out then the whole balance remaining on the mortgage will be due.

This is a grey area. Since you are benefited by the easement, you are the dominant tenement, and the other property is the servient tenement. The owner of the servient tenement may not take any action that obstructs or hinders your lawful use of the easement. But cosmetic issues of the easement have nothing to do with exercising your easement rights, and absent other facts, you may not have a right to force him to clean up his mess.

The client has the final word in how their case is resolved and most aspects of how it is handled, as long as it does not require the attorney to violate the law, or the rules and regulations on required and prohibited attorney conduct. Many attorneys, myself included, also include a provision in their attorney/client agreements that provides the attorney controls procedural aspects of the case and decisions about them, such as the timing and extent of discovery, motions and other pretrial procedure, the choice and order of presenting evidence at trial, etc. Other than that, the client is free to make the final decisions in the case.

As Mr. Selik said, however, refusing to follow your attorney's advice can have significant consequences, and not only the obvious consequences if you are wrong and the attorney turns out to be right. If a client consistently refuses to follow the attorney's advice, or refuses on a really serious issue, that is indicative of a serious break-down in the attorney/client relationship and may not only permit, but require the attorney to withdraw from the case. In addition, in a contingency fee case, where the attorney only gets paid when the case settles or a judgment is paid, the client's refusal to settle for an amount the attorney advises is a good settlement, will result in the attorney having to continue to work for what may likely be no better and possibly a far worse result. At that point you are messing with the attorney's livelihood and most if not all contingency attorneys will at least seriously consider withdrawing from a case if the client is unreasonable about following the attorney's advice regarding settlement. At that point the attorney has a right to withdraw, and a lien for fees on the final judgment or settlement, and the client is left looking for a new attorney to take over.

Last winter, when it snowed, (I live in central Massachusetts) I had a little trouble negotiating the small hill that is the entrance to our townhouse. My argument is that I purchased the car under the assumption that it was all-wheel drive but it obviously was not. They told me that they would have to take it under advisement. My question is about "Implied Warranty Law" and whether that would apply to this case, and whether there is any timeframe to use that as there is with the Lemon Law. The implied warranty of merchantability merely means that something must be fit for its usual purpose. It does not apply to things you assumed. Unless a misrepresentation, upon which you reasonably relied, was made that the vehicle was equipped with all wheel or 4 wheel drive when it wasn't, the buyer beware law requires you to examine and do due diligence to determine exactly what you were buying. There is no such thing as a "quick deed." Was it QUITCLAIMED? If so, there is no such thing as what you ask. Once it's deeded, you own it. Period.

The best I can tell you is that if you have a dispute about land, a lawyer can't answer it without reading the deeds and documents, so make an appointment with one and tell him the facts (you never have posted what is wrong) and he can probably help you.

I can't imagine why you need to. Should you sell or transfer the property, your name on the deed would just be "Jane Smith f/k/a Jane Jones." I guess if you really wanted to, you could get an attorney to draft a strawman deed to make a name change (which you might want to do to add your husband to the deed), but it shouldn't be necessary just for a name change. If you're trying to get a new mortgage or something, a copy of your marriage license will suffice.

I received a call just this morning from a car renter who had a quest who smoked in the rental car he had to turn in. He stated that the tape (Smoke detector) had turned a deeper color, indicating someone had been smoking. I was unsure of the tape system he was speaking of, and the only suggestion I had was to not only shampon the carpet and upholstery, I would have to sanitize the air circulation systems to eliminate the smoke odor. I'm researching the smoke detector system

If you are wondering how you might smoke in a rental car and not get caught, you're out of luck. I can always tell when a customer has smoked in a car. The smell gets into the upholstery and the interior plastics and is very obvious to people who don't smoke. You might not smell it, but we can.

Having a good partnership agreement is extremely important. Now things are great and both of you are full of hope and enthusiasm, so such an agreement may not seem important. But, since most startup companies fail, you really need to plan for such an event. Basically, partnership agreements deal with "what if" scenarios. Unlike, what people may think, such agreements do not have to be 50 pages long. An attorney will be able to help you create a succinct agreement that deals with the important issues.

Think of it this way, if you expect to make significant amounts with your friend (you should define significant amounts however that means to you) then you ought to be prudent and protect your investment and have a good agreement in place.

The court is responsible for appointing the Personal Representative. However, someone can petition the court for the appointment. Other family members can serve as PR or even non-family members so long as they reside in Florida. The court may appoint an outside PR if no one petitions to serve. Keep in mind, under Florida law a Personal Representative is entitled to compensation for serving in that capacity (unless they waive their fees), and their fees and expenses are paid before most other claims against the estate, even distributions to heirs.

The court would name someone, not his brother nor brother's wife. The court would follow Florida Probate Law which states preference for Personal Representative. However, if you or someone else is looking to be the alternate, a Petition for Nomination of Personal Representation can be filed. The person would have to qualify as a Personal Representative. Because they want to rule out or rule in someone. Heart attack is common and can occur naturally or be induced. They want a copy of the will to see who benefitted from the person's death. If a person was elderly and was induced to make a will leaving all to a stranger and disinheriting spouses or children and the person died under mysterious circumstances a short time later, that might suggest to the police that the person who benefitted had something to do with the death. Review of the will could also show that the spouse and/or children benefitted, that the will was made awhile ago and that nobody had reason to kill the deceased.

You don't indicate the age of the deceased or your relationship to the deceased or why you are making an inquiry. If you are the person who is a suspect, I would be cautious in speaking to the police and you might want to consider consulting a criminal law attorney in order to protect yourself. The police are not your friends and can and will use anything you say against you.

Keeping in mind that I have not had the opportunity to review the will, and I am here assuming that your mother is still living, unmarried, and that what you are talking about is what you understand her will is going to provide (unless she changes the will prior to her passing), then the short answer is no. That your brother did not comply with your separate agreement has no impact. Of course your mother has the right to change her will to take into account these matters.

I agree with Attorney Canipe but there are a few questions here. How is it that a loan is in your name and your mother own the real property? Is this some kind of personal loan to you or is the loan secured by the real property somehow? Its not possible to loan someone money and have the loan secured by property that they do not actually own so if this is a mortgage, is your name on the deed?

If this is somehow a personal loan, why does your mother not just add you to the deed now with right of survivorship?

Unless there is some written agreement then your brother need not comply by paying half the loan and you cannot just arbitrarily change the terms of your mother's will upon her death to reimburse yourself.

As suggested by Attorney Canipe, your mother is free to make other arrangements regarding the house and indicate that your brother does not get the house at all or that he can only have 1/2 minus his reimbursement for his share of the loan. Your mother is free to change her will, provided that she is mentally competent to do so, at any time before her death.

There are many possibilities here and I think your mother, if she is still mentally competent, needs to sit down with an experienced estate planning attorney to make some adjustments to her will.

If there is some kind of promissory note signed by your brother, that is a different matter. If that is the case, you could pursue legal action against him for non-payment and if you recovered a judgment then you could exercise it against your brother and, if your mother passes away, against your brother's share of your mother's estate. My guess though is that you have nothing in writing but verbal promises of your brother and if that is all you have, then your mother needs to change her will now and leave your brother no part of the house unless he reimburses you for his share of the loan. Frankly, if I were you, I would not want to own any part of real estate jointly with brother so your mother needs to make other arrangements and leave the house to you.

The high blood alcohol content and the child in the car are aggravating circumstances which will be considered by the prosecutor and judge. She could also be charged with a misdemeanor violation of Penal Code section 273a(b), which carries a punishment of up to one year in the county jail.

She will want to take immediate, proactive steps to demonstrate that she is meaningfully addressing what certainly appears to be alcoholism. This will help her personally and with her court case. CPS could definitely get involved here, as it is likely the arresting agency filed a report with CPS.

She would be well advised to get experienced legal counsel.

I often see mothers make this accusation of the guy being mentally unstable when they file for divorce. Well so do Judges and Madam it is quite ordinary for couples who are divorcing to get angry and do things out of spite and emotions.

Madam, California is a no-fault state. All your documentation you have mentioned in your post, about how he treated you, it is unnecessary. Get a lawyer if you want anything other than joint custody, you're not doing it right and any forum post won't replace an attorney who has done it already.

Come up with a shared custody plan. After you file and he responds you'll go to mediation. Have something ready, propose it and get on with your lives.

If you entered on a K-1, then you were required to have returned home if you did not apply for adjustment of status, pursuant to your marriage to a U.S. citizen, as it appears you are well aware.

However. as far as TPS goes, you only have until December to apply (but this will NOT allow you to get a "greencard", since you are still inadmissible due to the fiance visa issue from 2001). Please refer to www.uscis.gov (& search "Syria TPS") for more information, including the following:

If you do not currently have TPS for Syria, you may file an initial application to register for TPS for Syria under the recent re-designation. In order to register for TPS status, you must file your TPS package during the 180-day registration period that runs from June 17, 2013 through December 16, 2013. We encourage you to register as soon as possible within the 180-day initial registration period.

In addition you might be required to file a Waiver of Inadmissibility (See: www.uscis.gov, & search "TPS Applicants Seeking a Waiver of Grounds of Inadmissibility Under INA Section 244(c)(2)(A)(ii)").

You do have a deadline to file for TPS for Syrians. That you last entered the US on a K visa will present some complications. The terms of the K visa require that a person entering the US on a K visa either marry and adjust based upon the marriage to the petitioner, or depart the US. Clearly you did not do so. At this time you may be able to file for a waiver with the TPS application. You will need to use form I-601 for the waiver. For now you may want to focus on filing for TPS and the I-601 with the TPS application, and prepare an I-130 immigrant visa petition. From there you can review your options for adjusting to a green card - but TPS would give you a nice change, as it will provide proof of employment authorization. What you describe sounds unusual. Illinois law allows an employer to make a deduction from your pay only if and when you provide written authorization. In most instances, the written authorization must be given at the time the deduction is made.

Friday, late afternoon, I signed a Final Decree of Divorce, sent via email by my wife's attorney. I emailed the signed copy back to the attorney. We negotiated an uncontested settlement. Later, I realized there was objectionable language that I did not agree to. My wife and her attorney will be going to court this coming week (I don't know when) to finalize the divorce.

Is there a motion I can file to halt the final proceeding, in hopes of getting that language removed?

I don't know what language you disapprove of in the Decree you signed, but to do what you want to do, you really do need to hire a qualified divorce attorney.

Hypothetically, as I know nothing about your case, until you hire an attorney (and the attorney should be doing this) you should send an email with a dated letter addressed to her attorney and he, revoking your signature on the Decree and stating why and tell him that you do not agree to him proving up the Decree that you signed on ___ date, as you have revoked your signature on that same Decree and his authority to prove-it-up, and make sure to copy the court.

The attorney also needs to call her attorney (or you) and advise him of same.

Then, go down to the court and file the letter immediately with the court clerk and go see the Judge's clerk and give her a copy of your filed letter and tell her to give it to the Judge and to flag your court file.

Then, send a copy of the filed letter that you sent, to her attorney.

There is more to be done after this but you need to hire a good attorney.

Your attorney will then need to file a Motion to Revoke and Object to the Entry of the Decree, but it has to be in proper legal form.

And if he already proved-up the Decree your attorney will need to file a Motion to re-open the case.

You will only have 30 days from the entry of the order, and there is no guarantee that the judge will re-open the case as you have to have a basis to re-open and I do not know if you have a legal basis to re-open if it was entered.

What you need is a contract that sets out what you are buying, title insurance, and a lawyer to walk you through the transaction. If the deal is as simple as you indicate, the legal fee should be a few hundred dollars and the title costs the same, some of which your seller might pay. Absent this how can you possibly know that you're getting a clear title, as the mortgage may not be the only matter encumbering the property (think past due property taxes)? Or are you just going to trust the seller, who apparently is in such financial straits that he must sell his property for just what's owed on it?

I had a work related back injury in August of 2008. I've been seeing an ortho specialist since December 2009. He performed a spinal fusion in January 2012. I returned to work in August, 2012. The doctor was going to make me P & S on August 22, 2012, however, a student push me and knocked me over on August 21, 2012. My employer considered it a new injury, not a reinjury, and since they had changed insurance carriers, I had to see a different doctor. On January 17, 2013, the insurance carrier from injury 1 stated that the doctor for injury 1 was no longer in the MPN, and that if he did not make me P & S on January 30, 2013, that I would have to go the QME on February 20, 2013, and that I could no longer received treatment from Doc. #1. From what I understand, I can request continued care from Doc 1 and have up to one year to find another doctor. Also, Doc #2 just made me P & S on 1/25/13. Can the insurance carrier force me to see the QME or can I continue with doc#1 and have him make me P & S as he deems appropriate?

The reason I was ticketd was false report an officer made he said my brake light was out.He Came up to my car and said roll your window down I cracked it and he got mad and asked me to step out of the car. 1) They can arrest you for the brake light. They generally don't, but they can.

2) Your car can be searched without a warrant and without permission subject to arrest for inventory.

3) Obviously you do not have the attitude or ability to control your words or temper to represent yourself and get a favorable outcome. If you want to win, you need to hire a lawyer who will most likely change to a jury trial - the right choice.
