I was arrested by a police officer for FRAUD/CHECK FORGERY/ECT.. After I unknowingly presented a counterfeit $20.00. After I was informed that the bill was fake by the cashier, He handed the bill back to me. I gave the bill freely to the police officer and explained the situation. All of a sudden I was being detained! Went to court and found out the DA rejected the complaint. I am wondering if I have a case against the police dept. since the had no Federal Officer there and no proof that I new the bill was fake?
Answer
Since the charges were dropped, no jury wold give you any money.
Answer
NO. All government agencies and agents are protected and immune from suit for things done even mistakenly or negligently in the course of their duties. Do you really think that every person arrested but not convicted has the right to sue?? The system would instantly collapse.
