Here's what happens; you turn the key and a small amount of electricity travels to the solenoid, it trips the magnetic switch, which completes a circuit to allow more massive amount of energy to engage the starter motor. This is why you hear the clicking when your battery is low. The clicking is simply the solenoid switching on and off.

Short answer is that you can do very little. Your attorney was correct in that only one charge can be sealed or expunged. If the charge was dismissed, then you just need to explain to the employer that it was dismissed. Otherwise, just use common sense and explain how your life has changed since these charges.

Her father has had primary custody of her the last 2 years as I had a medical issue (epilepsy) that made it impossible for me at the time to care for her. I had to move to Florida to get support from my family while stabilizing my condition. In those 2 years, my daughter's father slowly started cutting down on my "visits" with her until they became nonexistent. He changed his phone number and deleted his e-mail account. I had no way to get in touch with my daughter (for 8 months) unless I physically traveled out there (which I couldn't afford at the time). In the last month, he's had a mental breakdown and his mother is filing for guardianship of my daughter. I was JUST served the paperwork and the hearing is in 3 days. Luckily, I will be able to attend in person. In her statement to the courts she gives them nothing but incorrect information about me as a person, the original custody agreement, and my relationship with my daughter. I have a paper trail to disprove everything she says in her statement. I didn't file any paperwork against her as I was told by the court house that she would be notified of my attendance. They also informed me that she has the right to request a reschedule for any reason. (Knowing her, if she knows I'm attending the hearing, she WILL do this as I am flying from out of town and can only be there for a couple of days). I basically have 3 days to figure out what I need to do to not only object to her petition for guardianship, but to request primary custody of my daughter as I believe it's in her best interest to be with me. How do I go into this hearing?

If possible, I would suggest that prior to the court hearing that you "pick up" your daughter such that she is NOT in the custody of the grandmother at the time of the initial hearing. You may even wish to use the P.D. to help you since she is in fact your child and not the grandmother's. The court would normally prefer to keep the status quo once you go into that initial hearing. Also, if the child is not with the party asking for temporary custody, at the time of the initial hearing, then certain statutory presumptions kick in which could even involve CPS. I would highly suggest that you get qualified experienced legal counsel who works a lot with guardianships to help you with this matter. Good luck!

If the land is not leased, you can apply to the court for a receivership lease. Revenue is than paid into the registry of the court for the benefit of the unknown heirs.

If the minerals are leased and producing income, this is the operator's problem. Often the operator will simply escrow the funds or attempt to place them into receivership.

Another option would be to try to open an administration of the decedent's estate.

I have had this issue before. If you can get the records from DMV and your payment proof a Court can vacate the new charges.

even though you paid the tickets and restoration fee on line, you license was not actually restored. You are suppose to receive notice from the N J Motor Vehicle Commission that your license has been restored before you can officially drive again. Since you paid the tickets, you definately want to go to Court to explain to the Prosecutor that you were only suspended for tickets and that they were paid. You also want to bring all your documentation to show that the tickets were paid. Although the prosecutor may offer you what is know as a 340 (i) which is a subsection of the Driving while suspended statute concerning parking tickets, and you would only pay a $100.00 fine, it would be better if the Prosecutor would agree to amend the Driving While Suspended to a downgrade that only carries a fine and no insurance points. There are no motor vehicle points with this offense, but your insurance company will assess insurance points. It would obviously help to have proof that the restoration fee was paid as well. Question is would the prosecutor agree to amend your summons to a better alternative than just a subsection (i) without the help of a lawyer? I do not have an Answer, but you could try on your own. Normally a first time conviction for Driving while suspended carries a minimum fine of $500.00 and a potential suspension of your license between 1 day and six months. A second or third conviction carries a higher fine and jail time so obviously if you have been convicted of Driving while suspended in the past, you will want to get a lawyer. You can tell your lawyer that you want to take the case to trial. It is not the lawyer's decision to settle your case - it is your decision. That said, your lawyer probably wants to maximize the value as well. If you go to trial, you will have to pay back PIP the $8K out of anything you win. Do you think you will win $31K at trial?

This is a little tricky. First off, if they are exempt, it is perfectly legal. In fact off-hours fundraising events are usually considered part of the normal job of an exempt non-profit employee. For hourly employees, the key is that it be TOTALLY voluntary. Many non-profit employees work where they do because they are dedicated to the mission, and happily put in volunteer time on top of their paid time. For others it is just a job. Every employee is legally free to make that choice. The key is for the employer to assure that it is a FREE choice. If there is any whiff of favoritism to the employees who volunteer time or disfavored status to those who don't, then the employer is at risk for unpaid wage claims from employees who work unpaid hours.

The 2nd marriage is only legal if there was no impediment to its being a valid marriage. It is bigamy if a person enters into another marriage while still legally married to someone else. Just because there is no proof now of a divorce does not mean one was not obtained. If a divorce was indeed procured, then it does exist in the courthouse of the Parish or County where it was granted. The clerk of court of the particular Parish/County can easily confirm if a divorce was obtained. A phone call ought to do it. It is a valid marriage as to the 2nd spouse however, if the second spouse honestly thought they were entering into a legally valid marriage.

In California, the law governing accidental overpayments is that the recipient is under a duty to refund the excess, unless both of two conditions are present: (1) neither party suspected, or had reason to suspect, that the payment was too large at the time it was being made, i.e., there was a mutual mistake; and (2) the party receiving the overpayment has materially altered his financial position in reliance on his (mistaken) belief that the payment was correct. Sounds to me as though the first condition for you to keep the overpayment has been met, but then the court would dig into what became of the overpaid funds to see whether you had materially altered your finances in good-faith reliance on the correctness of the payment. I don't know how well you'd do here. If you're a rich guy and this extra money just went into your bank account (or the like), you'd lose. If, on the other hand, you used the overpayment to pay off your mortgage, or to pay your grandmother's doctor bills, or even lost it all at the racetrack, and you aren't well-to-do, you'd probably win.

If Arizona law applies, the answer might be the same, but California lawyers wouldn't know and shouldn't advise.

I think the key here is the lawsuit. What did the 2nd lienholder demand in the suit, and with what result? Did the borrower present a defense? I recommend going to the court and giving the file a complete review, or having a lawyer do this.

There is no such thing as a redemption deed in California. Are you talking about property in another state? If so, you need to ask the question of the Law Guru panel in that state. There is also no such thing as a rescission of a deed of trust, at least not as a title document. You could obtain a judgment for rescission of a deed of trust and record the judgment. You are also making no sense when you say the "Bank foreclosed on the 2nd lien holder." A lien holder is the one who forecloses, not who is foreclosed on. If you are talking about property in another state where these terms have legal meaning (such as TX which does have redemption deeds), you need to re-ask the question under that state in LawGuru. If you are talking about California property, you need to have someone help you get your terms corrected and description of the events you are asking about straightened out, so we can tell what you are talking about.

As long as the employer wants to suspend you. At some point I believe a suspension can become a de facto termination, qualifying you for unemployment. You'd have to check with EDD to be sure. If there is such a time limit, that would be the only limitation on how long the employer can keep an employee on suspension.

I assume that you have a typo, in which you mean "he did not" instead of "he did." Given your grammatical errors and typos, I imagine he would not have understood your response if he had read it.

You are wasting your time suing a judge. They have immunity. If you feel you have been unfairly treated by a judge, the proper remedy is to file a complaint with the California Commission on Judicial Performance.

I need to understand my rights as a customer who bought an HP computer, under warranty, in which HP is not fulfilling in a reasonable manner and I feel it's time to file a law suit. The details over the past few months would make your head spin. So to summarize:

1) Purchased an HP All-In-One PC on in Sept. 2012 (w/2-year warranty) from the HP website online store.

2) On 06/20/2013 the Video Card went bad. HP shipped it for repair.

3) On 09/17/2013 Sound went out. HP shipped for repair to replace motherboard.

4) Received computer back from repair on 09/30/2013. PC would not boot up. Tech support had me dismantle computer over the phone, the tech center forgot to screw the hard drive into the chassis! It was lose which pulled out a SATA cable. PLUS, the tech center cracked the back of the computer!

5) HP now agreed to replace it. Which took almost a month to do! Received replacement on 10/25/2013.

6) Turn on my new replacement and the screen seemed dark. Went to "Settings" and under the "brightness" icon (a sun), it says, "Unavailable".

7) As of today, 11/21/2013, almost another month, tech support, plus my case manager have accessed my computer remotely 4 times, taking screenshots and such. HP says they do not know what is wrong or why brightness is not working. They said that this is a current problem with their 19", but not their 23" (which mine is a 23") But obviously it IS a problem. They tell me that it must be replaced and send me a proposal for another replacement.

8) I accept the replacement on 11/07/2013. Then I get a call from HP saying that my PC configuration is no longer available in my All-In-One model and they offer to replace it with a desktop PC of greater value. They send me the specs and I agreed, but they needed to add a touchscreen monitor, because that is what my computer is. My case manger says that shouldn't be a problem.

9) It's been two weeks and nobody will give me any answers! Everyday I call and/or email HP and all they will tell me is that a team is working on it. They rarely return my calls or emails, and I have been given every excuse you can imagine for not getting back with me... power outages, training, meetings, days off, servers down, etc.

Not only am I under warranty, HP has first broke my computer themselves, then they send me a defective replacement straight out of the box, but they feel they can take all the time in the world to make things right. I'm sick of them taking advantage of me and I'm sure other customers. When I ask to speak with a supervisor, I am told I am at the highest level possible and there is nobody else to talk to and I have to just wait.

Today, like most days, my case manager emails me to tell me, "sorry, I have no new information for you." I have complained to the BBB, and HP responded that they have offered me a new desktop replacement. I wrote the BBB back and told them HP is lying because if they had, I would have taken it and be using it right now. So the BBB reopened the case a few days ago since HP did not follow through on their promise. HP has no timeframes and they could care less about customer service. They are avoiding me and not answering my questions.

I am ready to take legal action but need to know what to expect, or what can I ask for. I have never been interested in a refund, never even asked for one. I have only wanted a computer that works! I feel I have been extremely reasonable and patient but I am tired of their games and what HP to be held accountable and responsible for how they treat customers.

Would this be a case that would be covered by any "lemon laws" in Illinois? What about the Magnuson-Moss Warranty Act? Do I have to prove damages to get more than just a refund? Would I need a lawyer? Do I just file at my local courthouse? Please, any help or advice you can give me would be greatly appreciated!

Again, all I ever wanted was a computer that worked or the replacement I was promised and I still wish that is what I could get, but even once HP would put the replacement into production, it is usually at least 2 weeks more to receive it, so I am not even close to getting this problem fixed. I have spent countless hours over the phone dealing with issue and I'm just plain exhausted.

This is a small claims case in Illinois, but you'd have to file a complaint, pay to serve them (you need their corporate agent in Illinois to do so), etc., but with the above facts a judge is still going to say, your warranty gives you a new unit. Magnuson Moss can apply but so can the warranty itself; MM allows you to file in any State court. You can also contact the FTC since this was sold in Interstate Commerce, or the Illinois Attorney General's Office of Consumer Fraud & Protection. And, until you get a resolution, you'd be out of pocket for a replacement product that works for you.

Relocation by 50 Miles Requires Court Consent

"Relocation" was previously interpreted by the courts to mean permanently moving out of state. But, the Florida legislature has now redefined the term as moving 50 miles or more from the other parent's residence. A custodial parent, who seeks to move more than 50 miles away from the other parent's residence is now required to serve a Notice of Intent to Relocate upon the other parent and prove, by detailed information, why relocation should be granted.

Non-Custodial Parent can Respond and Request a Hearing

The non-custodial parent has the right to file a written response within 30 days, but more importantly has the right to an evidentiary hearing at which he/she can have witnesses testify and can introduce documents into evidence. The Notice must include the following information:

A description of the neighborhood and area

The address of the intended new residence

The phone number of the intended new residence

The date of the intended move or proposed relocation

The reasons for relocation.

If one reason is based upon a written job offer, the offer must be attached

A proposed visitation schedule, and transportation arrangements

Custodial Parents Need Significant Reason to Move

It may not be sufficient for a custodial parent to show only that the planned move would provide a "support system" (family, friends, etc.) to her/him or the children. Similarly, it may not enough to show that a higher paying job is available in the planned location. However the more factors which can be provided to the court, including additional factors such as offering substitute visitation and a contribution toward travel costs for the other parent, may suffice. Whether the non-custodial parent has been an active parent is also a significant factor. A difficult situation exists when a non-custodial parent has been active with the children, but the employer of the custodial parent or her/his new spouse requires a transfer to another state. In sum, there is usually no easy way to determine in advance whether a court will grant relocation. Case evaluation, preparation, and presentation are essential in relocation cases.

If there are no existing Orders in place, then you both have equal rights to the child. You need to bring an action in Family Court to have your rights, responsibilities, and obligations outlined to prevent problems such as you describe.

I would note that there is a statute that provides that unmarried mothers have sole custody until the Court says differently, but that statute is more of a necessity to prevent kidnapping of newborn children than a weapon to be used against fathers in custody cases.

These are complex issues, and it is important that they be handled correctly. Therefore, it is important that you consult an experienced family law attorney to find out what options are available to you based on the facts of your particular case.

Remove the old t-stat. be sure to clean the surface on the housing as well as the surface on the engine head. Put the new t-stat in the dead. (be sure it in the right way) Put gasket sealer on the new gasket and place on the head. Place the housing on the gasket being carfule to keep the gasket in place. Replace the bolts. Be sure to tighten them evenly or you will break the housing. Make sure bolts are snug. Relace coolant. Start engine and check for any leaks.

In answring the complaint, see if you qualify for a court costs waiver (there are forms for this by the Judicial Council). If your boyfriend wants to file for custody of his children without proof of serious endangerment, he can do so provided that mother has had custody for more than 2 years. Prior to that he needs to show serious endangerment. That requires more than sloppy housekeeping or impoverishment. That being said, this is not your business: 1) he is your boyfriend, not your husband; 2) these are his kids, not yours; 3) an attorney would be representing him not you. And, finally, the process is alot more involved then the kids just telling a Judge that they now want to live with Dad. Getting custody is an expensive and time-consuming process and should not be attempted without the aid of an experienced attorney. Possibly Mom will now agree that the kids can come live with Dad, but without her agreement, Dad isn't likely to get very far.

Several months ago I won a judgement for $900 in small claims court from the owner of a tree cutting company who's operation caused damage to my car. No one was hurt. The debtor failed to pay, failed to show for an Interrogatory Summons, and failed to show for two different Rule to Show Cause hearings. The judge recently issued a Capias to have him arrested. His blatent disregard for court orders is causing me significant inconviencene and expense in time of work to attend all these hearings. Can I file a motion for treble damages, with a reasonable chance of winning, to be compensated for this inconvience?

Currently he pays the bills. I Have a friend in Maryland who is willing to help us get on our feet, provide transportation, and a job, but my question is, can I legally leave with my children without him saying I kidnapped him? Do I need to go through the courts? I believe there is a custody paper out on our 3 year old, but it is over 3 years old. He makes feeble attempts to see the girls, often going out drinking. You have to file a Notice of Relocation, which gives him the chance to object to your move. If he doesn't object, you can leave. If the "friend" in Maryland is male, that reduces your chances considerably. You should make an effort to obtain work here in any event.

As you seem to be aware, extra is a separate category of work than production assistant and, customarily, when a person on a film set performs more than one function, they get paid for each function (although not necessarily a full salary for each). Especially where it is a convenience to a producer who finds himself "short" a person and needs to keep shooting. As a first step, you could contact the company that employed you (the one named on your paycheck) and point out you worked as an extra and expect to be paid for that. You should receive the same amount they paid the other extras. If unions were involved, you could report it to the actors' union.

I think they're just trying to get money. Can you tell me if anything has been revised and should be updated in our trust for either of these documents?"

To clarify: have there been any updates on the HIPAA or Pour Over will since 2008? Nothing has changed in our trust. I found somewhere that there was an HIPAA update in 2004, but that should be covered in the 2008 one.

The "sarcasm aside" remark was to the prior attorney's answer, which I found sarcastic and impolite. I don' t think you should have to update the HIPAA because that is basically to protect the doctor from your claim that s/he violated your privacy by discussing your medical condition with another. The HIPAA authorization allows the doctor to do that. That being said, I don't think it needs updating but that is only based on scan facts, Deanne. As to the Will, what circumstances are there that have changed that the lawyer refers to in saying you need to update it? Ask flat out, why do you think these need changing?

It was meant to be sarcastic because a lawyer cannot advise you as to whether a trust needs updating, or what you need to do without reviewing your estate planning needs and reviewing the trust and any other estate planning documents such as your health care directive and the pour over will.

It is tantamount to someone asking me about a contract without letting me see the contract. Any lawyer who answers without reviewing those documents and items is simply engaging in idle speculation. If you put your trash in a dumpster that you were not supposed to use, then it would be reasonable for the owner to go through the trash enough to verify who had used it without permission, but it would be an invasion of privacy to use the contents to contact any of your clients. If the person he called thought the call was indicating you had done something illegal, then there might be a cause of action for defamation, but how much in damages could you show? Likewise, you have grounds to sue for breach of contract and his attempt to illegally lock you out [taping the door shut], and might be able to collect for the increase in rent you have to pay in a new location and the cost of the move and interruption to your business. Your major problem is showing you have enough damages to justify the cost and trouble of a lawsuit and finding an attorney who would handle it, unless you are satisfied with the $7,500 limit of Small Claims Court, where often not much may be given for pain and suffering damages.

What in the world did you wait so long for? There is a procedure in California to file a motion to have the lis pendens expunged and the successful moving party can be awarded their attorney's fees.

Ask the title company to give you a quote to "bond around" the claim. You should provide them every bit of inforrmation you have to show the claim is no longer good and the amounts involved. This way you can close, and the Lis Pendens can be resolved after the closing. This is gouing to cost you, but you should be able to close. If your title company refuses to bond around the issue. get another title company.

You should have checked title when you elected to list the porperty for sale. I'm surprised your broker did not do so early on.
