My teacher hit me with my marker in the cause he thought I was using my phone which I wasn't can he do that?

That used to be called necessary and appropriate classroom discipline.
If you suffered bleeding or broken bones or other serious injury, other than to your self esteem and pride, you might have a legal claim. Barring that, you should treat this as a teachable moment about attitude, behavior and compliance with society's rules. Sorry to disappoint you.
