Question

check fraud

defendant has a terminally ill mother..she is an only child..can her sentence be forgiven because of this? or reduced? or is any weight given to this at all?Does it depend solely on the sentencing judge Thanks

Answer

Re: check fraud

A terminally ill mother will not nullify a criminal act. It may help with sentencing. Contact an attorney. You may have other ways to beat the charge.

Answer

Re: check fraud

Certainly not "forgiven"(commuted), and probably not even reduced(but she could still try), and, yes, it would up to the original sentencing judge to decide to reduce it.
