I am now being told that in the next coming months, I will have to actually buy the car from his estate (an estate that will be under my full control when I turn 25). They finally began repair in December of 2012 1/2 of my unit walls are demo'd to the studs and waiting to finish repair for roofing replacement. Are you asking whether this is a winning strategy? Without knowing how the HOA sees their responsibilities in this situation it's rather difficult to handicap. My guess is that you would have some chance to prevail, but probably less than 50%, based on defenses the HOA is likely to argue. Also, Small Claims Courts are less predictible than Superior Court because the judges are less experienced. In addition, some of your potential claims may be outside Small Claims rather limited jurisdiction. If there is any way to handle the matter by negotiation, I'd go that way, even if significant compromise is necessary.

Back in December of 2012, about two weeks after the closing of my home(organized through this bank), the bank deposited a check from the home mortgage branch, whom I paid all of the closing costs to, in the amount of $700. I remembered my banker telling me that if they didn't need all of the money paid to them at the closing they would cut me a check in blank amount. So I assumed that was the case and really didn't put much thought into it at all. I didn't sign the branches check, I never even seen the check.. from what the bank lady that called me said, the teller just deposited it into my account for the bank. They are now asking me to pay them back. Needless to say, I no longer have that money and I am currently a full time student with two children living on a very tight budget...paycheck to paycheck... what are my options? This is in IA.. Child support stops when a child reaches 19. He can ask that you be ordered to contribute to the child's college education expenses from your income AND YOUR ASSETS - a different test than child support. Your deal regarding child support may not be of any importance to the court.

You would have needed to file a charge of discrimination with the EEOC within that timeframe to preserve your claim. However, if there was a sexual assault or some other unwanted sexual contact, you may also have a tort claim for battery which has a longer statute of limitations. I own a california automotive smog facility which is overseen by the bureau of automotive repair, I had a customer come in and ask me to perform a smog check inspection she signs the work order and left to return later to pick up her vehicle. My smog tech then proceeds to "smog check" the vehicle and comes into the office (after the test is complete) to inform me that the vehicle failed (for something we have no control over) I informed the customer she comes into the office pays, also informs me that I should have known it was going to fail and not smoged it (it doesnt work lie that), we did not know the vehicle would fail and I tried to explain this to the customer, i took about 30-45 min to carefully explain the best I could with her, in the end she thanks me pays and leaves. The next day she goes onto google, yelp and is making lies up in order to leave negitive feedback, she now is claiming that I knew the vehicle would fail and I only failed her vehicle in order for her to have to unnessarly re-test the vehicle for an additional fee. (I also want to add that when she came to pick up her vehicle she then informed me that another person recently was working on her truck and disconnected the battery which made it fail because the computer was not ready to be tested, her argument is... that I should have known that it was going to fail for that reason, she is also now saying that she informed me of all this prior to the inspection when she dropped off the vehicle, which is 100% false)
She came in asked for a smog inspection, we did so, the vehicle failed by way of something we could not see nor have any control over, she is upset with us and believes we should have known this. Even if we did "know" the vehicle would fail, it does not matter we are to test the vehicle "as is" according to the state.
She has put in a complaint to the BBB as well as our state agency that oversees automotive repair, and made negitive comments making false claims. My issue is, irregaurdless of the claims this customer makes, the state agency has to come out and conduct an investigation and even is the find it to be without meritt it will stay on our record. She is also asking that her money be refunded for a service in which we already provided, because her vehicle failed.

They have six years from the date of the offense to bring charges.

The prosecutor has 6 years to charge you, however, once they charge you, a warrant for your arrest can stay in the system for many, many years. While the state can still charge you with OWI if your BAC was .07, it does make it more difficult for them. The state actually has two ways to convict you. One is showing that your BAC was .08 or more. The other is by showing that your ability to operate your vehicle was affected due to the consumption of alcohol - they do not have to show your BAC to convict you of this one.
That being said, you should immediately sit down with a lawyer who handles OWI cases. I work on OWI case all the time and can tell you that there is more than just the BAC. I look for other things to see if there are any other defenses. For example, I recently got a Not Guilty verdict for my client who had been driving and had a BAC of .14%. The reason for the not guilty verdict is that the prosecutor could not prove what my client's BAC was at the time of driving. The blood test was conducted 3 hours after my client drove and he was drinking after getting out of the car. Make sense?

Very interesting question, your parents are tenants want to evict you, a non-paying resident who is essentially subtenant at $0 a month. Well if your parents try this self-help and dump your things outside you could call the cops that you've been unlawfully evicted without proper notice. The cops would probably show up and let you back in and say something about this being a civil matter.
About notice, if you never agreed to pay rent there is no 3 day notice to quit or cure here, rather I think your parents would have to give you 30-60 days notice to leave. If you lived there more than a year its 60 days, otherwise its 30 days notice to leave. If you were damaging the place then 3 day notice to cure may apply.
Not much to prevent this than to talk it over with your folks. Ask for 60 more days if you've been there over a year as you're entitled to that under the law.

The notice is legal especially if you came to the unit as a guest but have stayed longer than the community rules allow for overnight guest visits. You need to consider your grandmother's housing status and leave as quickly as possible so that she will not lose her home. As you are not a tenant, you are not actually entitled to a notice, however your grandmother may be served with a 30-day or (90-day notice if she lives in subsidized housing) terminating her tenancy for a violation of the community rules. The seven-day notice is a version of the 3-day violation of covenants and conditions notice that a landlord or property manager may serve on a tenant who has violated lease terms.

They often turn into a tug of war where possession dictates who has the benefit of an asset.
Ultimately, in a divorce, Minnesota law defines the marital estate (community property) as any asset acquired during the marriage whether that asset is held in the name of either party or both. This specifically includes real estate, cars, pensions, 401K plans, business interests, stocks, bonds, stock options, dogs, cats, chairs, collectibles and bank accounts etc . . . If one party has dissipated (gotten rid of) assets in anticipation of a divorce, the value of those assets may be considered as part of the divorce property and debt division. They remain marital.

I live in Atlanta, Ga. I have a clogged tub that has been relatively stopped up since August and has gotten progressively worse. I have contacted my landlord and now she says that I will be charged $75 repair fee and that she will cover the rest of the repair. She says, "per the lease, there is a $75 maintenance fee". The lease says that the tenant is responsible for repairs. I showed her the ga landlord tenant handbook; in short, it states that the repairs are the landlord's responsibility at no cost to the tenant. She says that the $75 charge is a deductible and that her clause in the lease is in accordance with ga law. The first thought that comes to mind (and the information not provided) is why the tub is clogged. If the tenant caused the issue (and obviously clogs are usually caused by the person actually using the sink or tub), the landlord should certainly expect to pay for some or all of the damage. All facts are relevant when reviewing the lease (and no one here has it to review the specific language).

The reason this has not received an answer is because it is several questions in one and the "towing" issue is not really a real estate law question. The questioner needs to decide which issue is most important and try to get that answered first. The towing question should probably be addressed to a lawyer that specializes in municipal law. As to the 2 driveway entrances, this is a more complicated question than it appears. I suggest that the questioner start at the local Building Inspector's office, look-up the property under both addresses and see what Permits have been issued. I recently filed for custody of my three month old daughter (we all live in Connecticut if that helps). My ex boyfriend is on the birth certificate and has been in and out of her life since birth, and as of two weeks ago stated he didn't love her and wished she wasn't born and wanted to give up his rights. A few days later he accuses me of not letting him see her even though he missed six visits in a row on his own. He began harassing me and I called the police. He was spoken to by the police and told he is not to have any contact with me at all and any custody matters should be taken care of in court. I was also told because there are no custody orders in place they cannot enforce anything, meaning they can't force me to let her see him, but if I did, they cannot enforce him to give her back. After filing for custody, I recieived a set of emergency orders that automatically go into place, one of which being that both parents should maintain normal contact with the child until the hearing (which is scheduled for next month). I'm not sure what to do. I don't want to be in contempt of court by not allowing him to see her, but I also don't want to risk not having my daughter for a month because the police can't make him give her back.

If you will notice, the language of the automatic orders state that both of you " shall assist [your] children in having contact with both parties, which is consistent with the habits of the family..."
The "habits" of your "family" are that he has not had consistent contact with your daughter, therefore, I do not believe you are required to let him see her prior to any orders put into place on your court date.

The modern trend in California decisions relating to prescriptive easement claims based on misplaced fences, etc. in urban settings is NOT to recognize an easement. The property line per the deed, and as found by a competent survey based on the recorded deed, will usually be recognized, and claims of either a prescriptive easement or an adverse possession will be rejected

They may try to make a claim for a prescriptive easement. I agree with Mr. Whipple that the courts are reluctant to apply this doctrine to a boundary dispute. Too much. If you wanted to exercise all legal rights it would require a lawsuit to compel. It sounds like, and I could be mistaken, a great deal of personal property was destroyed (trailer). Trailers characterization as real or personal usually requires a bit of investigation of facts to be able to know how the law would describe it. In any event here is what I think: 1. wife, and possibly you, have a claim for conversion seeking money damages; 2. the value of the claim may or may not be worth pursuing considering the costs of the suite, value of property destroyed, and the degree of family turmoil it may create; 3. However the supervised settlement worked out by DOL for back pay works out to 1/2 time for hours worked instead of time and one half. Is there some exclusion factor which would permit this? I dont have a diagram however removing the transfer case is a fairly easy process, if you are referring to the driveshaft yokes ford uses a couple different setups, usually at the rear of the transfer case going to the rearend is a slip yoke, you simply unbolt the u-joint at the rear end and slide it first forward to clear the pinion yoke and then back to slide it out of the transfer case, or a bolt yoke where you will 4 bolts or nuts to remove at both ends of the driveshaft. same thing goes for the front driveshaft, then there will be 8 bolts between the transfer case and the transmission some of them are kinda tough to access, ratchet wrenches are a lifesaver here, then remove the speedo sensor and the shift linkage which should have a long flat bar with a rubber connection in it you can pry apart with a small pry bar and some wd40. then a simple twist and pull backward and it will come loose. it will be heavy but is usually managable without a tranny jack.

I agree w/ Mr. Moens. The seller is trying to be "cute" and is putting both him and you at risk over what is a relatively minimal amount of transfer tax. That being said I have had deals where the seller excluded a fridge, washer/dryer and some specialty fixtures (such as a dining room light fixture) but either agreed to replace the items as part of the deal or sell them separately, but that is relatively rare. And certainly never for anything "attached" and never for anything close to $25000.00. For the amount of transfer taxes involved, the risk is not worth it and frankly, the buyer side risk is higher.

Last winter, my was stolen and vandalized. The thief pled guilty of the crime. He was ordered to pay restitution for the damages that were done to my car. However, he has not. I have called the victim services and have been told that there is nothing that can be done until the police send out a warrant, which they have not. (Actually, I have been told various things by victim witness and cannot seem to get a straight or consistent answer). Most frustratingly, there is information on his Fcebook that indicates where he lives and yet I have been told the police won't accept that information until they have a warrant. I also have some concern that he may leave the country (he is not a US citizen) before I am paid.

Unfortunately, restitution orders are frequently ignored, and the only thing you can do to encourage the criminal system to help you if nagging at the police, DA and probation Dept. You could file suit against him to obtain an enforceable judgment. Someday you may find some assets or income you can collect against. The most important thing is to get your son better. If in fact, the other party is "under insured" then your policy should pay for medical expenses through med pay.
Your son may have a claim against both the driver of the car he was in and maybe the person in another vehicle that may have caused the accident.
In any event, report everything to your insurance company and no matter what do not settle with anyone until you have talked to a lawyer and your son has reached an end medical result.

To start a divorce, you have to serve the other party. Even if you don't know where they are, you have to try to find them (we us a low-cost detective to search), and you have to state to the court that you cannot find him and petition the court to serve him by publication, which involves publishing a notice in the newspaper for 5 weeks.
You then can proceed to a divorce. After filing financial disclosures and a couple other documents, and 90 more days, the court will enter a decree of divorce by default and you are done.

The divorce decree is the document that (once signed by the judge) indicates that the divorce is final. The only way there would be a decree is if the two of you have reached full settlement, and signed and submitted a decree to the judge, or if there has been a trial and the judge has issued rulings on any contested issues in the case. If your case is ongoing, there would not be a decree yet. I don't have any information regarding the status of your case, but I do recommend you consult with an attorney who can give you specific information based on your situation. My vehicle was impounded by local police, but I was not ticketed and was allowed to leave the scene. My only passenger, my teen daughter, was taken to her primary doctor after the fact- as no medical treatment was offered on scene, with pain and numbness in her arm. I am scheduled to see my doctor for neck and back pain also.
My question is, where do I go from here? Will any of my medical or totaled car be covered by the at fault driver, or am I facing very serious penalties and judgements? I have a very good driving record, with no tickets or accidents, so this is all new to me.

The fact that you were uninsured does not make you liable for judgments. However, you will be responsible financially to those who towed your car or provided you medical care not cover by your health insurer.
Not having insurance, does complicate things, though. You should hire a local attorney.

Well, without reviewing the documents it may be impossible to say. There are two kinds of "common elements". One kind is "common element" such as the roof, which protects the entire building. LIkewise, if the building has central heat and air, it is possible that the main ducts are also common elments. However, there are also "Limited Common Elements" which are common elements that serve one, or more, but not all the units. This normally includes your windows, entry door, etc, and could include ductwork that branches off the main ductwork and serves only your unit, or a few units through multiple branches, etc. The Declaration may make a difference between "Common Elements" and "Limited Common Elements" and often the Association will not be responsible for "Limited Common Elements". So once you know exactly what ducts are involved you should check the Declaration again in particular because you may be responsible for Limited Common Elements repair and maintenance even if the Association is responsible for true "Common Elements", but I've seen weird-er things, especially in smaller buildings.....

You should always have a title search done on any property, but especially a foreclosure property, and if you are borrowing money to purchase the home, your lender will most likely require you to pay for title insurance as well. I would also recommend purchasing additional Owner's Title Insurance to protect you further from any title problems in the future. In your case, the seller may be willing to pay for the additional Owner's Policy. Check with your realtor to be sure.

Child support is payable until the child is 18 or 19 and still a full time high school student. Parents can be ordered to pay child support for disabled adult children unable to provide for their own support, which is a separate obligation. The SSI received as a result of the disability would be factored into any calculation for ongoing support. However, the right to make decisions or be consulted in making decision is not affected by a willingness or failure to pay support. Permission to enter a residence can be limited both in time and in the basis for the entry. For example, if A gave B permission to go into A's house to get a platter to borrow but instead B went into the house and stole the t.v.s and electronics, then this could be filed as a burglary. While this is the law, some times cops don't get that and / or prosecutors refuse to accept charges in these situations thinking the juries would have a hard time understanding.
Another example regarding timing - A housesits for B in January so A obviously has permission to be in the house in January. The following December, A enters Bs house to steal. This is a burglary because the timing & the basis of the permission.
A visits B during the holidays. A lives in another city so A stays with B for about 10 days. 6 months later A goes in B's house and steals. This is a burglary.
A lives with B so A can enter any time A wants. A moves out to another place. 1 year later, A enters B's house to steal - this is a burglary even though it was not explicitly stated but it is clear to everyone that A no longer had the right to enter the house (& never had the right to steal.)

First of all I live in Kentucky. I put a deposit down on an apartment that the landlord said would be ready to move into in twenty days. No lease was signed and he said that if it wasn't read by then I could have my money back. He wrote that out on a piece of notebook paper and signed it because he did not have his receipt book. The apartment was not ready on time and I never heard from him again. I still have the piece of paper. What can I do to get the deposit back? I know he is renting out that same apartment now to someone else. I can not get a hold of him.
